I~BLI6 HEARING CASE # <br /> <br />INTRODUCE ORDINANCE TO VACATE DRAINAGE AND UTILITY EASEMENT ON <br />LOT 1, BLOCK 1, RIVERVIEW BOWL; CASE OF TIM HOLM <br /> By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Tim Holm, owner of Lot 1, Block 1, Riverview Bowl (site of Holm's Superbowl) and Lot 3, <br />Block 4, Riverside West, recently applied for and received Staff approval for an administrative <br />subdivision to convey the southwesterly 24 feet of the Superbowl site to Lot 3 of Riverside West. <br />In conjunction with Administrative Subdivisions, a routine procedure is to vacate any drainage <br />and utility easements on existing common property lines and dedicate replacement drainage and <br />utility easements on what will be the new common property line. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br /> <br />c) <br /> <br />Site location map <br />Exhibit prepared by Hakanson Anderson Associates identifying easement to be <br />vacated and replacement easement to be dedicated <br />Proposed ordinance to vacate drainage and utility easement <br /> <br />Notification: <br /> <br />In accordance with State Statue, property owners within 350 feet of the subject property were <br />notified of the public hearing to consider vacating the existing drainage and utility easement on <br />current common property line. <br /> <br />Observations: <br /> <br />The City Engineer has verified that there are no drainage structures within the existing easement <br />to be vacated. The applicant will be required to provide the City with replacement easements on <br />the new common property line. <br /> <br />Recommendation: <br /> <br />City Staff recommends that Council introduce an ordinance to vacate the drainage and utility <br />easement. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance #03-__ to vacate the 5 foot drainage and utility easement on the <br />westerly 200 feet of Lot 1, Block 1, Riverview Bowl. <br /> <br />Reviewed by: <br />City Engineer <br />City Attorney <br /> <br />CC: 07/08/03 <br /> <br /> <br />
