Case #3: 3.2 Percent Malt Liquor License Renewal <br /> <br />Police Chief Way stated that applications for renewal of the following licenses have been <br />received and are deemed to be in order: <br /> <br />Off-Sale 3.2 Percent Malt Liquor <br /> <br />#03-01 <br />#03-02 <br /> <br />Bill's Superette <br />SuperAmerica #4508 <br /> <br />15299 St. Francis Boulevard NW' <br />14000 St. Francis Boulevard NW <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Pearson, to approve 3.2 percent <br />malt liquor license renewals for Bill's Superette and SuperAmerica #4508, for 2003-2004 license <br />year. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Pearson, Cook, Elvig, <br />and Zimmerman. Voting No: None. <br /> <br />Case #4: <br /> <br />Request for Final Plat Approval of Highlands at River Park 3rd Addition; <br />Case of Arcon Development <br /> <br />Community Development Director Frolik stated that on September 11, 2001, the City Council <br />approved the preliminary plat for Highlands at River Park. The approved preliminary plat <br />consists of 157 single family urban residential lots proposed to be developed in three phases. On <br />February 26, 2002, the City Council granted final plat approval to the first phase, which consisted <br />of 58 lots. On June 25, 2002, the City Council approved the second phase, which consisted of <br />another 64 lots. On March 24, 2003, the City received an application for final plat approval of <br />the final 35 lots remaining in the approved preliminary plat. City Code states that preliminary <br />plats are valid for one year from the date of approval. The preliminary plat for Highlands at <br />River Park was approved on September 11, 2001, and expired on September 11, 2002. Only two <br />of the three phases of Highlands at River Park had been final platted within that one year time <br />frame, which is an aggressive schedule. Therefore, the developer needs an extension to the <br />preliminary plat approval in order to obtain final plat approval of the final phase of Highlands. <br />City Staff supports the request for an extension to the preliminary plat approval, ha addition, City <br />Staff has incorporated language into the draft amendment to the Zoning and Subdivision <br />regulations to allow the City the flexibility to grant preliminary plat approvals beyond the one- <br />year time frame when the project has an approved phasing plan that will require more than one <br />year to complete. All 35 lots conform to the sizes and dimensions approved on the Preliminary <br />Plat. This phase of Highlands will receive public street access by the extension of 155th Lane <br />N.W. to the east and Waco Street N.W. to the north. The standard drainage and utility easements <br />have been provided around the perimeter of all lots. All other drainage facilities are also <br />encumbered with easements. The development of this final phase will include construction of a <br />trail connection with the easterly terminus of 155th Lane N.W. and Bear Park to the east. <br />Sidewalks will be required along the north side of 155th Lane N.W. to connect with the trail link <br />that commences at the terminus of the cul-de-sac. A sidewalk will also be required on the east <br />side of Waco Street N.W.
