9.14 Solid Waste <br /> <br />9.14.01 Purpose and Policy. It has been determined that improper waste storage, <br />collection, transportation and disposal endanger the public health, safety and welfare, <br />create public nuisances, result in scenic blight and adversely affect land values. Since <br />this type of land use must meet or exceed the rules and standards established by the <br />Minnesota Pollution Control Agency (MPCA), those same rules and standards must be <br />met before a conditional use permit may be considered by the Council. Additionally, <br />performance standards must be met to assure that all conditional use permit requests will <br />be reviewed using criteria that will prohibit land uses that endanger the public health, <br />safety and welfare, create public nuisances, result in scenic blight or adversely affect land <br />values, or create land use conflicts due to landfill operations and landfill related activities. <br /> <br />9.14.02 Scope. In addition to the criteria outlined in Chapter 9.03.04 of the <br />Ramsey City Code pertaining to conditional use permits, these are rules and standards <br />that regulate the'issuance of conditional use permits for storage, collection, <br />transportation, treatment, utilization, processing, transfer, intermediate disposal, and final <br />disposal of solid waste or processed waste product by any person and the issuing of <br />conditional use Permits for the construction and operation of solid waste disposal sites <br />and facilities for the protection of the environment in keeping with Minnesota Statutes, <br />§115, §116, {}400 and §473D. <br /> <br />9.14.03 <br /> <br />Definitions. For the purposes of this Section: <br /> <br /> Ash~- means the incombustible material that remains after a fuel or solid <br />waste is incinerated. 4. <br /> <br /> Buffer Area - means the outer area of a site where the site activity is <br />screened, distanced, or muffled from adjacent land uses. At a minimum the buffer area <br />must be consistent with the intent of MS {}473.823 Subdivision 3. <br /> <br /> Commissioner - means the commissioner of the Minnesota Pollution <br />Control Agency. <br /> <br /> Disposal Facility - has the meaning given it in Minnesota Statutes, <br />{}115A.03, Subdivision 10. <br /> <br />Floodplain - is as defined in Minnesota Statutes, Chapter 104. <br /> <br /> Industrial Solid Waste - means all solid waste generated from an <br />industrial or manufacturing process and solid waste generated from non-manufacturing <br />process and solid waste generated from non-manufacturing activities such as serVice and <br />commercial establishments. Industrial solid waste does not include office materials, <br />restaurant and food preparation waste, discarded machinery, demolition debris, or <br />household refuse. <br /> <br />9-114 <br /> <br />105 <br /> <br /> <br />
