Councilmember Elvig stated that he voted in favor of holding a public hearing, but he was not in
favor of stuffing sewer and water into an area where they don't want it. That being said if the
residents come forward and want the improvement he would like to be able to provide it to them.

Mayor Gamec stated that the way the City Charter is written is that any property owner opposed
to the project would not be required to hook-up to City services or pay for the services until the
time they do hook-up to City services.

Principal City Engineer Olson explained that this would be a pilot project and they would not
authorize another project until the City hits a break even point.

Councilmember Kurak inquired if they were looking at all three projects together our would they
be separate.

Principal City Engineer Olson replied that each project has a separate feasibility study and can be
acted on separately.

Councilmember Elvig stated that he wants to make sure that the residents are provided a copy of
the study prior to the public hearing.

Principal City Engineer Olson noted that staff would be sending out a copy of the feasibility
study with the public hearing notice.

Mr. Murphy stated that last time the issue was addressed the people were afraid that later on the
Council would change their mind and require them hook-up so there was some talk on adding
language to provide some security to the residents.

Principal City Engineer Olson replied that there has been some discussion on repealing the Due
on Sale Clause.

Councilmember Zimmerman inquired if any of the parcels will be assessed for any portion of the
project.

Principal City Engineer Olson replied yes.

Councilmember Zimmerman inquired if the residents could petition against the assessments.

City Attorney Goodrich replied yes.

Mayor Gamec requested that the City Attorney research whether or not the City can assess for
only the pavement portion of a project if sewer and water extension is a part of the project.

Motion by Councilmember Zimmerman, seconded by Councilmember Cook, to ratify the
recommendation of the Public Works Committee.

P70

City Council/June 10, 2003
