Staff's Proposal

Requiring the accessory structure to be located
on the same parcel as the principal dwelling
unless otherwise approved by City Council
(Sub& 4. a)

Stating Accessory Structure Home
Occupations will not be permitted for auto
related businesses (Subd4. e)

Maximum of 4 non-resident employees
allowed (based on parcel size) (Subd. 4 d)
Statement related to restricting businesses that
create excessive vehicular traffic in a

residential 'neighborhood (Subd. 4 e)

or stored indoors.
storage of materials
(Subd. 4 f)

Outside storage of vehicles and equipment
must comply with section 9.11.10 of City Code
- which requires vehicles and equipment to be
screened, located in the rear and side yard and
Not permitting outdoor
related to the business

Applicant's Proposal
Permitting an accessory structure to be located
'. on a parcel adjacent to the principal dwelling

Took this section out. Proposing auto related
businesses in the comprehensive list of
permitted businesses (stated later in proposed
ordinance)

Permitting 10 non-resident employees

"Operations which generate average daily
vehicular traffic in excess of 3 customers per
hour per acre of land between the hours of
9:00am and 8:00pm within the neighborhood
shall not be permitted." "Operations which
generate any vehicular traffic between the
hours of 9:00pm and 8:00am other than arrival
and departure of employees shall not be
permitted."

Permitting the storage of materials and
equipment related to the business on parcels
greater than 5 acres. Storage areas are not to
exceed 1,000 square feet if an accessory
structure exists and if one is-not present they
are allowed to store materials and equipment in
an area equivalent to the size a home owner is
allowed for accessory structures

No exterior signs or displays ale permitted Allowing one wall sign for each accessory
(Subd. 4 g) structure not to exceed 6 square feet
Business is not

permitted if the findings
determine the operation may constitute a fn:e
hazard, affect surrounding neighboring
property values or constitute a nuisance (Subd.
4 h)

Staff is not proposing to include a
comprehensive list of permitted businesses as
it is difficult to address every business type
that may or may not be an appropriate
residential business

Providing for a general list of prohibited
business: engine and body shops, ammunition
manufacturing, motor vehicle repair or sales or
other objectionable uses as determined by the
City Council

Took this section out. Included State Statute
language related to hazardous waste facilities
and storage of hazardous materials

Providing for a comprehensive list of
businesses that shall be deemed compatible
with a residential neighborhood. For example:
Machine Shops, welding Shops, and steel and
glass fabrication, print shops, small automobile
body and repair shops, etc.
Lists specific businesses not permitted and
took out provision "other objectionable uses as
determined by the City Council"

It appears that the ordinance proposed by the Applicant would be better fit for a commercial or
business district. Staff is attempting to establish language that will keep any business operation
in an accessory structure secondary to the residential homestead and not adversely affect the
character of a residential neighborhood.
