CASE # <br /> PUBLIC HEARING <br />REQUEST FOR A VARIANCE TO SWIMMING POOL SETBACK REQUIREMENTS; <br /> CASE OF CRAIG AND DEBORAH KOSNOPFAL <br /> By: Amy Geisler, Associate Planner- <br /> <br />Background: <br /> <br />Craig and Deborah Kosnopfal have applied for a five-foot variance from the minimum separation <br />between a swimming pool and a well. The property is located at 16300 Yolite St. NW. The <br />following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site layout <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify all owners of property within 350 feet <br />of the subject property of the request for variance and public hearing date. <br /> <br />Observations: <br /> <br />The Kosnopfals are requesting the variance due to the fact that their contractor installed an above <br />ground swimming pool 15 feet from their well, instead of the 20 feet required by City Code. <br />Current Code requires the 20-foot distance to ensure that service vehicles are able to access the <br />well for any needed repair work. It is the opinion of the Building Inspection Division that there is <br />sufficient room on the Kosnopfals' property to accommodate this concern. A below ground pool <br />located the same distance from the well could have implications for seepage into well water; <br />however, since the Kosnopfals' pool is above ground, water contamination is not a concern. <br /> <br />Recommendation: <br /> <br />Staff recommends the request for variance be approved. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #03-07-__ adopting Findings of Fact # __ relating to Craig and <br />Deborah Kosnopfal's request for a variance to the swimming pool setback requirements on the <br />property located at 16300 Yolite St. <br /> <br />-and- <br /> <br />23 <br /> <br /> <br />
