Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION//03-07- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO SWIMMING <br />POOL SETBACK REQUIREMENTS AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Craig and Deborah Kosnopfal, hereinafter referred to as "Applicants," have <br />properly applied for a Board of Adjustment variance from Section 8.21.05 of the Ramsey City <br />Code to allow for a swimming pool to encroach 5 feet into the well setback for the property <br />located at 16941 Yttrium St., NW and legally described as follows: <br /> <br />Lot 6, Block 4, Carol-Rose Acres, Anoka County, Minnesota <br />("Subject Property"). <br /> <br /> AND WHEREAS, the Board of Adjustment conducted a public hearing on July 10, <br />2003, pursuant to Section 8.21.05 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That based on Findings of Fact #__, a variance for a swimming pool to encroach into the <br /> 20-foot well setback area on the Subject Property is hereby granted. <br /> <br />2. That the swimming pool shall maintain a 15-foot setback from the well. <br /> <br />'3. That the Permittees shall obtain all the necessary permits and inspections. <br /> <br />4. That the property owner shal~-be responsible for all costs incurred in administering and <br /> enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> , and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this <br />the 10th day of July, 2003. <br /> <br />29 <br /> <br /> <br />
