The developer must assure that wetland <br />permixing, soils, or steep ~ades do not prevent this stage one improvement. <br /> <br />The developer is invited to examine the feasibility Of siting the infiltration ponds on e,'dsting <br />park property, so as to reduce the destruction of mature trees at the extreme southwest comer <br />of Block .3. <br /> <br />The preliminary plat will be forwarded, to the. Park Commission for'its January I0, 2002 <br />meeting. The City, has the option for cash, land, or a combination of the two. The 2002 rate <br />for park dedication is S1700 per unit; there is also a trail development fee of $400 per unit. <br />The decision of the Park Commission will be reflected in the development a~eement for The <br />Ponds. <br /> <br />13. <br /> <br />Trails: The Trail Development Fee is $400 per unit. The Park Commission's previous <br />recommendation was to allow credit for certain 8' bituminous trails constructed as a Stage 1 <br />improvement. These Were the se~m-nents west of iodine Street,. between Block's 1 and 2 and <br />the trail connecting the Townhome area of the plat, south to the e,'dsting trails via a new trail <br />on the west side of the wetland in Park 1. The trail route from Dysprosium Street, west to this <br />same trail should be completed at this same time. If it is, versus waiting until the proposed <br />apartment building receives approval, it also would eligble to be credited against the Trail <br />Fees due. The trail should be incorporated in to the hard surfaced 'fire lane' shown to the rear <br />of the apau~ent building. <br /> <br />In keeping with policy, no trail Credit wOuld provided-for th~ required trail.along County <br />R.oad #5. Credit is available for any portion constructed on the City's water tower property. <br /> <br />14. Environmental Review: Shortly after the City Council meeting regarding the original <br /> preliminary plat, the City received notice from the State Environmental Quality Board (EQB) <br /> that a citizen petition had been filed in relation to The Ponds subdivision requesting that the <br /> City require an Environmental Assessment Worksheet (EAW') be prepared for the <br /> development. Prior to the meeting, staff had already determined that a mandatory EAW was <br /> not required since the minimum thresholds that the State of Minnesota requires for <br /> environmental review were not exceeded. State re~lations require the City Council to <br /> determine whether or not an EAW should be required. Due to the fact the ori~nal plan was <br /> withdrawn, the City Council has not made any determination on the EAW. The revised <br /> preliminary, plat will require the City. Council to make a determination on whether or not an <br /> EAW should be required. <br /> <br />-52- <br /> <br /> <br />
