grants the CITY a license to enter on each lot of the Plat in order to install the improvement <br />described in this paragraph if the same has not been previously constructed. <br /> <br />14. Street Cleaning. After the street surfacing is installed, the DEVELOPER shall clear any <br /> soil, earth, or debris from the streets within the Plat resulting from any construction within <br /> the Plat by the DEVELOPER or its successors and assigns. From time to time, the CITY <br /> may remove accumulations of soil, earth and debris from the streets resulting from the <br /> construction of the Plat. It shall be the DEVELOPER'S responsibility to pay the costs <br /> associated with this necessary street cleaning. Invoices from the CITY to the <br /> DEVELOPER for such costs shall be paid within fifteen (15) days of the date of invoice. <br /> <br /> SECTION III <br />PERMITS AND OCCUPANCY <br /> <br />15. Requirements for Building and Occupancy Permits. No building permit for any lot in the <br /> Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the <br /> structure; (b) a Certificate of Survey, including that survey information required by the <br /> CITY has been supplied to the City Building Official; and (c) all the financial guarantees <br /> required by the CITY have been satisfied. No occupancy permit for any lot in the Plat shall <br /> be issued until: (a) vehicular access to the lot is provided including the installation of at least <br /> one layer of bituminous surfacing; (b) all utilities are in place, operational and accepted by <br /> the CITY; and (c) boulevard sod and landscape tree, or escrow for same, have been provided. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />16. Cash, Land, and Park Improvements. The Plat is located in the Rum River Recreation <br /> District. Park dedication requirements shall be satisfied as follows for this phase, as well as <br /> all subsequent phases as represented in the approved Preliminary Plat & Existing Conditions, <br /> Sheet 1 of 3, prepared by Westwood Professional Services, Inc., dated April 10, 2001, <br /> Revision August 9, 2001. <br /> <br />The Park Dedication requirements for the 74.37 acre Highlands At River Park property, shall <br />include a total of 2.91 acres of land dedicated adjacent to Woodland Green, Bear, and the <br />unnamed Park at the North edge of the Plat. This land dedication represents 39% of the Park <br />Dedication due on the Plat. The actual dedication of the land shall occur at the time the <br />phase adjacent to the park(s) are final platted. <br /> <br />The remaining park dedication requirements shall be met by park improvements equating <br />One Hundred Twenty Four Thousand Five Hundred Dollars and no cents ($124,500.00) in <br />cash value, based upon the 2001, $1300 per unit Park Dedication Fee and a total of 157 lots. <br />The value of any park improvements provided by the DEVELOPER shall be determined by <br />the lowest of three qualified bids or by mutual agreement between the parties and may <br />include associated design, inspection and staking costs. The CITY may choose to complete <br />any portion of the work, including, but not limited to, inspection, clearing and grubbing and <br /> <br /> <br />
