Also concurrent with any construction adjacent to the three park sites, the DEVELOPER <br />shall pave the trail links or concrete sidewalk connections. At the time of Final Plat approval <br />for future phases of Highlands At River Park, the following park improvements will be <br />evaluated for satisfying the remaining cash Park Dedication due: <br /> <br />a) Parking lot at Bear Park <br />b) Ag lime infield at Bear Park <br />c) Irrigation for Bear or Woodland Green Park <br />d) Shelter adjacent to Woodland Green's play equipment <br />e) Trees and landscaping <br />f) Park signage <br /> <br />If the CITY demands a cash payment for any outstanding Park Dedication requirements, in <br />lieu of anticipated improvements above, the DEVELOPER may appeal the matter to the <br />Park and Recreation Commission for a recommendation to the City Council. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />Park Trail Development Fee. The City Council has enacted a trail development fee in the <br />amount of Three Hundred Twenty Five Dollars and no cents ($325.00) per lot. Therefore, a <br />payment in the amount of Fifty One Thousand Twenty Five Dollars and no cents <br />($51,025.00) (157 lots x $325/1o0 is due to the CITY for this Plat and subsequent phases <br />that would final plat the entire 157 lots as reflected in the approved preliminary plat. All or a <br />portion of this obligation may be satisfied by the construction of trail improvements within or <br />adjacent to the Plat. <br /> <br />Concurrent with the watermain construction from Barium Street NW to the Plat, the <br />DEVELOPER shall construct an 8-foot wide bituminous trail from T.H. #47 to Roanoke <br />Street NW. Credit will be assigned based on the lowest of three qualified bids or by mutual <br />agreement between the parties and may include any associated design, inspection and staking <br />costs. The CITY may choose to complete any portion of the work, including, but not limited <br />to, inspection, clearing and grubbing and restoration. In the event that the cost of the trail <br />improvements above exceeds $51,025.00, the CITY shall eliminate one or more segments of <br />the trail or shall reimburse the DEVELOPER for the costs in excess of $51,025.00. <br /> <br />Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with <br />CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations <br />prescribed by the CITY, not to exceed 5% in grade, along the wast side of Yakima Street <br />N.W. The costs associated with sidewalk construction are not eligible as a credit towards the <br />Trail Development Fees and/or Park Dedication requirements due on the Plat. <br /> <br />Tree and Sod Planting Plan. Sodded boulevards, in addition to a front yard tree, are a <br />requirement for each lot in the Plat prior to issuance of a Certificate of Occupancy. The <br />DEVELOPER is required to submit a Plan for CITY approval that identifies existing tree <br /> <br /> <br />
