associated with this necessary street cleaning. Invoices from the CITY to the DEVELOPER for such costs shall be paid within fifteen (15) days of the date of invoice. SECTION III PERMITS AND OCCUPANCY DRAFT 15. Requirements for Building and Occupancy Permits. No building permit for any lot in the Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the structure; (b) a Certificate of Survey, including that survey information required by the CITY has been supplied to the City Building Official; and (c) all the financial guarantees required by the CITY have been satisfied. No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the lot is provided including the installation of at least one layer of bituminous surfacing; (b) all utilities are in place, operational and accepted by the CITY; and (c) boulevard sod and landscape tree, or escrow for same, have been provided. SECTION IV PARK DEDICATION 16. Cash, Land, and Park Improvements. The Plat is located in the Rum River Recreation District. Park dedication requirements shall be satisfied as follows for this phase, as well as all subsequent phases as represented in the approved Preliminary Plat & Existing Conditions, Sheet 1 of 3, prepared by Westwood Professional Services, Inc., dated April 10, 2001, Revision August 9, 2001. Upon final platting of the first phase of the 74.37 acre Highlands At River Park, a total of 2.91 acres of land shall be dedicated adjacent to Woodland Green, Bear, and the unnamed Park at the North edge of the Plat. This land dedication represents 39% of the Park Dedication due on the Plat. The remaining park dedication requirements shall be met by park improvements equating One Hundred Twenty Four Thousand Five Hundred Dollars and no cents ($124,500.00) in cash value, based upon the 2001, $1300 per unit Park Dedication Fee and a total of 157 lots. The'CITY and the DEVELOPER., hereby agree to the following prioritized improvements and the process for implementation; P_.~g_Z Equipment A play structure will be installed in Woodland Green Park in the location of the existing equipment no later than October 31, 2002. The DEVELOPER shall submit three (3) different proposals for an installed play structure and associated appurtenances to the Park and Recreation Commission for approval for a project cost between $35,000 and $45,000 in value. The CITY shall authorize the project and prepare a memorandum of understanding, detailing the various responsibilities and costs to be deducted from the $124,500 in Park Dedication 'owed' to the CITY. -21-
