CASE #4 <br /> <br />RECOMMEND PARK DEDICATION FOR RIVER PINES 5TM ADDITION <br /> By: Mark Boos, Parks/Utilities Supervisor <br /> <br />Background: <br /> <br />On December 11th, 2001 City Council will have acted on a request fOr Sketch Plan approval for <br />River Pines 5th Addition. <br /> <br />On November 5th, 2001 the Planning Commission recommended the applicant proceed to <br />Preliminary Plat approval. It should be noted that until recently, the City had been requiring the <br />dedication of a 40' foot wide corridor on the west side of T.H.47 for a service road in this <br />vicinity. This had occurred to the south, with the platting of Apple Ridge. The 40' was intended <br />to accommodate a trail in addition to the service road. This trail will provide direct Connection to <br />Elmcrest Park as well as provide a safe north/south pedestrian route in the neighborhood. <br /> <br />As indicated, recent examination of vehicular transportation in the area-suggests that. a more <br />westerly north/south route is better than a frontage road and therefore, staff and the Planning <br />Commission are recommending that only the space necessary for a trail is warranted. <br /> <br />While the City owned outlot to the south is 40' feet in width, staff is recommending that the trail <br />routing along River Pines 5th Addition occur in a trail easement 20' feet in width. The primary <br />reason is that the minimum standard width for trail corridors in the urban area is 35' feet, and <br />this dimension would interfere with the rear yard property line setbacks to the existing house and <br />building. The dedication of a trail easement could be concurrent with the rear yard drainage and <br />utility easement, but may need to be recorded with a separate document other than that for the <br />Plat recording. This document would also exclude structures like fences from the easement, but <br />not preclude approved landscaping or drainage maintenance. <br /> <br />In keeping with past practice, trail construction will be required adjacent to T.H. #47 within the <br />plat, but not eligible for credit against trail fees due. Staff is recommending that the developer be <br />required to construct beyond the plat limits to the south boundary of Apple Ridge. The cost of <br />this construction should be deducted from the 'Trail Fees due. The Commissions Park and Trail <br />Plan map does not show proposed park in the vicinity of this plat. A cash contribution to satisfy <br />the minimum Park Dedication due would be; $22,100 at $1300 per unit (2001 rate) for each of <br />the 17 new lots created. The Trail Fee would be $5,525, based upon a 2001 fee of $325 per unit. <br /> <br />The Commission should also note that the only route for most residents of River Pines and Apple <br />Ridge to access the trail along T.H. #47 is on existing City street south of 158th Avenue. These <br />streets do not have sidewalks. <br /> <br />In terms of a recommendation on the above issues, the Commission can address them now, or <br />require the applicant to return to the Park and Recreation Commission as part of Preliminary Plat <br />approval. <br /> <br />Commission Action: <br /> <br />Based upon discussion <br /> <br />G:\users\City Shared File\Public Works Department\CommitteesLPark & Rec.
