515.56. Planned Unit Development(Ord. 400; 3/23/81) <br /> <br /> Subd. 1 Purpose and Intent, This Planned Unit Development Subsection is adopted for <br />the purposes of: <br /> <br />Providing the means for greater creativity and flexibility in environmental design <br />than is proposed for under the strict application of the existing zoning code while <br />at the same time preserving the health, safety, order, convenience, prosperity and <br />general welfare of the City and its inhabitants. <br /> <br />b. Recognizing the economic and cultural advantages that will accrue to the <br /> residents of a planned community. <br /> <br />c. Encouraging a more creative and efficient approach to the use of the land. <br /> <br />Encouraging the preservation and enhancement .of desirable site characteristics <br />and open space. <br /> <br />Encouraging a development pattern in harmony with land use density, <br />transportation facilities and community facilities, and objectives of the <br />comprehensive plan. <br /> <br /> Subd. 2 Rules, Stand. ards and Defi.n. itions. <br />interpreted in accordance with the following: <br /> <br />The provisions of this code shall be <br /> <br />This Planned Unit Development (PUD) section shall become a part of the City's <br />zoning code. Where inconsistent therewith, the requirements set by this section <br />shall be followed for Planned Unit Developments. This section shall have no <br />affect upon other developments or district requirements. <br /> <br />Planned Unit Developments may be excluded from certain requirements of the' <br />zoning code when specifically approved as a part of the Planned Unit <br />Development. Such exclusions shall only be granted for the purpose of creating <br />better overall design and an improved living environment and not solely for the <br />economic advantage of the developer. All provisions of the zoning codes not <br />specifically excluded in the Preliminary and/or Final Plan shall apply to the <br />Planned Unit Development. <br /> <br />The granting of a Planned Unit Development permit does not alter in any manner <br />the underlying zoning district classification except that building permits shall not <br />be issued which are not in conformity with the approved Planned Unit <br />Development. <br /> <br />Whenever a dispute arises concerning the interpretation and/or application of any <br />section of this code, the matter may be referred to the Board of Adjustments and <br />Appeals for hearing pursuant to City Code Section 505. <br /> <br /> Sub& 3. Relation of Planned Unit Development Site to Ad,iacent Areas. The design <br />of a Planned Unit Development shall take into account the relationship of the site to the <br />surrounding areas.
