Community Development Director Frolik noted that since the Planning Commission <br />recommended denial of the request, the Council would need to review the findings and tact and <br />determine if any changes should be made. The resolution would also need to be changed. <br /> <br />Consensus of the Council was to amend the fundings of fact as follows: <br /> <br />7. That the accessory, building will be for storage of three commercial vehicles and several other <br /> personal vehicles and equipment in order to alleviate off*street parking violations. <br />8. That the commercial business will not be conducted in the building. <br />13. That the proposed use will not substantially adversely impair the use, enjoyment, or market <br /> value of any surrounding property. <br />14. That the proposed use will .not be disturbing to existing or future neighbor12g cities. <br /> <br />Motion by Councilmember Kurak, seconded by Councilrnember Hendr/ksen, to adopt Resolution. <br />#01-08-314 adopting Findings of Fact #0569 relating to M_r. Lind's request ]tbra conditional use <br />permit to exceed the amount of accessory structure space allowed on the subject property as <br />amended. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Hendrdksen, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Councilmember Hendr/ksen inquired if it would be a significant delay if the Council were to <br />approve the permit at the next Council meeting. <br /> <br />Ntr. Lind replied no. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Anderson, to table the <br />issuance of the conditional use permit until September 11, 2001. <br /> <br />Motion can'/ed. Voting Yes: Mayor Gm-nec, Cotmcilmembers Hendriksen, Anderson, Kurak, <br />and Zimmerman. Voting No: None. <br /> <br />Case #8: <br /> <br />Request for a Conditional Use Permit to Operate Steel Warehouse Business <br />in a Residential District; Case of Scott and Patti Jarmoluk <br /> <br />Community Development Director Frotik stated that Lonny Menard resides at 8940 - 181~ <br />Avenue NW and currently owns the parcel to the west (8900 - 1813` Avenue). I2 1985, Mr. <br />Menard constructed a 5,000 (50' x 100') square foot pole building on the parcel to the west <br />without also constructing a principal dwelling. City Code states that no accessory structure shall <br />be built without the presence of a principal structure (dwelling) on the property. This would <br />result in the existing accessory structure being considered non-conforming.
