Councilmember Kurak replied that staff <br />should address the issue in the most appropriate matter identi~ing how the developer will pay <br />for the $130,000 deficit. Councilmember klendriksen'inquired if Ms. Kurak was suggesting that <br />the City not pay that additional cost. Council_member Kurak replied that was correct. <br />Councilmember Zimmerman 'stated that he was disappointed that the City did not ~ve the <br />existing residents some density transitioning. Councilmember Hendriksen stated that an offer <br />was made by the developer to put some covenants in place to provide buffering and questioned [f <br />that is included in the preliminary plat voted on. Dan Blake, Centex Homes, replied that the <br />additional primary structure restriction area is part of the preliminary plat presented and would be <br />included in any action taken. Councilmember Hendriksen inquired as to how that area will be <br />implemented. Community Development Director Frolik replied that it will be addressed in the <br />development agreement. ~Lr. Blake replied that they would probably create some type of <br />easement in favor of the City that would restrict what and could and could not be constructed in <br />that area. <br /> <br />City Attorney Goodrich recommended the following motion: To grant preliminary plat approval <br />requiting street alignment Option b, subject to compliance with City Code requirements and City <br />platting policy, subject to compliance with the July 5'h and August 21, 2001 City staff <br />compliance letters including the developer requirement to pay for all drainage requirements <br /> <br />Ci~ Council/September 11, 2001 <br /> Page 11 of 22 <br /> <br /> <br />
