Motion by Board Member Vfivoda, seconded by Board ~Member Kociscak, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Wivoda, Kociscak, Griffths, <br />and Reeve. Voting No: None. Absent: Board Member Johnson <br /> <br />The public hearing closed at 7:18 p.m. <br /> <br />Board Business <br /> <br />Chairperson Nixt called the regular meeting of the Board of Adjustment back to order at 7:18 <br />p.m. <br /> <br />Chairperson Nixt stated that the variance would allow the applicant to use the property in a <br />matter consistent with the rest of the area, but was hoping that they could fred a unique <br />characteristic to the property so that the variance could be in line with the current ordinance. <br /> <br />Board Member Kociscak stated that the property does not comply with the four and forty <br />requirement at this time because it is onlY five acres. <br /> <br />Board Member Wivoda stated that he did not see that they had the authority to approve the <br />variance request based on the information the Board has received. <br /> <br />Chairperson Nixt stated that the Board does not have any history to go on and if they do grant the <br />variance, it would give some precedent for other variances. <br /> <br />Chairperson Nixt inquired if there was any indication that the proposed Comprehensive Plan <br />would be approved in the near future. <br /> <br />Community Development Director Frolik replied that the Met Council has applied a 60-day <br />extension to review the plan. <br /> <br />Board Member. Kociscak stated that there is no property in the area that complies with four and <br />forty density requirement, which makes the situation unique. He stated that he thought it would <br />be unfair to not grant the variance. <br /> <br />Motion by Board Member Kociscak, seconded by Board Member Reeve, to adopt Resolution <br />#00-12-320 adopting Findings of Fact #0543 in the positive relating to a request for a variance <br />from Derek Nordvik to the four units in 40 acres density restriction. <br /> <br />Further discussion: Community Development Director Frotik explained that in order to legally <br />split the property Mr. Nordvik would have to begin with a gross acreage of 20 acres and then <br />divide the property into to two 2.5 acre lots and reserve the remainder of the property. Board <br />Member Wivoda inquired as to what type of precedent this will set. Board Member Kociscak <br />stated that they could include that the property is the largest plat in the area. Chairperson Nixt <br />replied that the property would violate the intent and purpose of the Comprehensive Plan and <br /> <br />Board of Adjustment/December 5, 2000 <br /> Page 5 of 6 <br /> <br /> <br />
