Before any further development, <br />please address the fotlowing issues: <br /> <br />The Phase II seniors housing development proposes an access to Trunk Highway 47. Although <br />there exists a dr/veway access for a single family home at this .location, the proposed <br />development is a change of land use and requires application for a new access permit per <br />Minnesota Rules 8810.5200. However, access to Trunk Highway 47 will not be allowed <br />because the proposed use is an increase in development intensity. When development intensity <br />increases along a highway, it degrades its capacity and safety. The Phase II development <br />should be designed to take advantage of existing ac'cess from County State Aid Highway 5. <br />Please contact Beth Neuendorf (651-582-1579) in lVln/DOT's Design section for additional <br />information. <br /> <br />Mn/DOTs policy is to assist local governments in promoting compadbiiiry between land use <br />and,,highways. Residential uses located adjacent to highways often result in complaints about <br />traffic noise. Traffic noise fi:om this highway could exceed noise standards established by the <br />Minnesota Pollution Control Agency (MPCA), the U.S. Department of Housing and Urban <br />Development, and the U.S. Department of Transportat/on. Minnesota Rule 7030.0030 states <br />that mumcipalides are responsible for taking all reasonable measures to prevent land use <br />activities listed in the MPCA's Noise. Area Classification (NAC) where the establishment of the <br />land use would result in violations of established noise standards. <br /> ; <br />Mn/DOT policy regarding development adja~nt to e,,dsting highways prohibits the <br />expenditure of highway'funds for noise mitigation measures in such areas.
