Mr. Holasek explained that they envision a nice office complex with a parkway along the fiver. <br /> <br />Community Development Director Frolik stated that the third issue has to do with the property <br />south of Highway #10 and west of the State Wayside Rest Park. Joe Nathe's property south of <br />Highway #10 at the Elk River border is currently zoned commercial. The Comprehensive Plan <br />Future Land Use Map designates Mr. Nathe's property and the other parcels located west of the <br />State Park as low density residential. Mr. Nathe is opposed to the proposed rezoning to <br />residential and wishes to maintain the commercial zoning. Staff has had telephone conversations <br />with Dennis Colby, property owner immediately adjacent to the Wayside Park and he also wishes <br />to maintain his commercial zoning. He has an option to purchase the adjacent vacant parcel to <br />the west and he wants that parcel also to retain its commercial zoning. There is one single parcel <br />in this area that is currently zoned single family residential. Back in 1996, at the property <br />owner's request, the City rezoned this parcel from commercial to residential. The property was <br />zoned commercial and, therefore, the home was considered lawful non-conforming. The <br />property owner wanted to demolish the existing home and build a new home on the property. <br />Because the property was zoned commercial, it would have required a conditional use permit to <br />build a new home on the property. To avoid the need for a conditional use permit, the property <br />owner requested a rezoning to residential in order to redevelop the property with a residential <br />rise. <br /> <br />Mayor Gamec inquired if the area along the river would be changed to residential. <br /> <br />A resident explained that they would like to see the area along the river as residential and the area <br />along the highway remain commercial. <br /> <br />Mayor Gamec replied that he thought made sense. <br /> <br />Councilmember Cook inquired if the area is divided for residential and commercial uses will it <br />make for reasonable size residential lots. <br /> <br />The resident replied yes. <br /> <br />Mayor Gamec requested that staff put together a plan for a combination of residential and <br />commercial and bring it back. <br /> <br />Consensus of the City Council was to designate the land use along the fiver as residential and the <br />land along the highway as commercial. <br /> <br />Mike Leary, Commercial Realty representing the Colby Property, explained that they are looking <br />at a 76-unit assisted living complex for the Colby property, which would include retaining the <br />existing single family house. As part of that development, they would have a walkway along the <br />river.
