5) Community/Town Center Garden Space <br /> <br />Community Development Director Frolik stated that the City's Environmental Specialist Bruce <br />Bacon has suggested a community garden space within Town Center. <br /> <br />Mayor Gamec replied that issue would have to be considered by the developer. <br /> <br />Councilmember Cook explained that the garden space would be for personal use by the residents <br />in the Townhomes. The City's Parks/Utilities Supervisor has suggested a community garden <br />space in a different location in the City where the City could rent out space to residents. <br /> <br />Councilmember Elvig stated that there will probably be a lot of empty nesters within the Town <br />Center and the garden space might be an amenity they would enjoy as part of the park and green <br />space. There has also been the suggestion of creating a garden club that would maintain the <br />gardens within Town Center. <br /> <br />Community Development Director Frolik stated that the next step would be to schedule a <br />meeting with Bruce Bacon and the developer. <br /> <br />Mayor Gamec stated that the Town Center area has to be kept up and it may be a concern if the <br />maintenance is done only on a volunteer basis. <br /> <br />Councilmember Elvig replied that he thought that they should at least look into the possibility. <br /> <br />Councilmember Cook stated that it would probably be worth trying, but there should be a back <br />up plan if it is not successful. <br /> <br />Councilmember Elvig requested that association maintenance of the common area be addressed <br />as part of the development agreement. <br /> <br />6) New Development Adjacent Property Grading <br /> <br />Councilmember Kurak stated that the City has had some problems with developers crossing over <br />onto other people's property when grading for a development or compromising another person's <br />property line by changing the grade dramatically. She felt that there needs to be a policy in place <br />that limits how close to the property line a developer can be when grading occurs. <br /> <br />Principal City Engineer Olson explained that the City has a maximum slope requirement of 4/1. <br />The issue of grading on someone else's property has occurred once in the City, but is generally <br />not a problem. If it does occur, the City has the ability to stop all construction activity until the <br />problem is resolved and the impacted property owner could pursue any damages. Staff would be <br />open to requiring construction fencing being placed along property lines. <br /> <br />Councilmember Kurak inquired as to how they address situations where a developer did not <br />cross over the property line but compromised the property line. <br /> <br />City Council Work Session/June 10, 2003 <br /> Page 7 of 8 <br /> <br /> <br />
