CASE # <br /> <br />LAND PURCHASE FROM LARRY SANDNESS <br />By: Steve Jankowski, City Engineer <br /> <br />Background: <br /> <br />Mr. and Mrs. Sandness own the property immediately west of T.H. 947, between 151st <br />and 149th lane. Their residence is located on Lot 1, Block 3, Gorham's Addition. When <br />Gorham's Addition was platted, 40 feet of service road was dedicated to the City, in <br />addition to an additional 17 feet of right-of-way which was dedicated to the State for T.H. <br />#47. Subsequently, the Sandness' purchased from Martin Gorham, a 60 foot remnant <br />piece along the south side of this parcel, which was not a part of the Gotham plat, so <br />neither the City nor the State right-of-ways were dedicated on this piece. <br /> <br />The service road has been constructed and maintained over this parcel, and the City has <br />rights to its continued use because of this. However, the City would not have any rights to <br />construct utilities through this parcel and it appears likely that sewer, water, and storm <br />sewer may be needed through this parcel in the near future. There would also be some <br />question as to how much right-of-way to which the City or State may be entitied. <br />Generally two rods (33 feet) on either side of the traveled center line is acknowledged as <br />the effective right-of-way in such cases, but an expansion of T.H. #47 beyond its 33 feet <br />right-of-way from center line may not be able to utilize this area since use rights belong to <br />the City and not to the State. <br /> <br />Since the Sandness' recently hooked up to City sewer, conversations with them on <br />resolving this potential future problem have occurred. They are agreeable to transferring <br />fee title rights to the City for $1,000 for a parcel 60 feet by 47 feet. <br /> <br />Recommendation: <br /> <br />Staff recommends acquiring this piece from the Sandness' for right-of-way purposes for <br />$1,000. <br /> <br />Finance Committee Action: <br /> <br />Motion to recommend Council authorize acquiring this 60 x 47' piece of property from the <br />Sandness' for right-of-way purposes at a cost of $1,000. <br /> <br />fc4 <br /> <br />Reviewed by: <br />City Engineer <br /> <br />FC: 09/26/95 <br /> <br />Copies also distributed to: <br /> <br />City Administrator <br />Finance Officer <br /> <br />/jmt <br /> <br /> <br />
