CASE # <br /> <br />LAND ACQUISITION FOR SUNWOOD DRIVE <br />By: Steve Jankowski, City Engineer <br /> <br />Background: <br /> <br />The alignment of Sunwood Drive through the Ben Deemer property is illustrated on the <br />attached sketch. Preliminary conversations with Mr. Deemer have raised several issues <br />which we would like to receive input from the Councilmembers. <br /> <br />The City needs to obtain Parcel E for the right-of-way of Sunwood Drive. Acquisition of <br />Parcel E will sever Parcel F from the buildable portion of Mr. Deemer's property. Less <br />than an acre of this parcel toward its eastern boundary would be necessary for a drainage <br />easement to establish a sedimentation pond. Is there a public interest in acquiring the <br />remainder of Parcel F. Mr. Deemer does not wish to sell Parcel F in that he prefers not to <br />have public access to the lake. However, it should be expected that the public will attempt <br />access anyway due to Sunwood Drive being directly adjacent. It should also be expected <br />that severance of this parcel will result in an acquisition cost. <br /> <br />Mr. Deemer also owns property on the west side of Sunfish Lake Boulevard which I have <br />labeled Parcel G. Sunwood Drive would be extended a distance of 58 feet through this <br />parcel and needs to be acquired for right-of-way. Mr. Deemer wishes to sell the remaining <br />piece of Parcel G to the City. Does the City wish to acquire this remaining piece. <br /> <br />In any case, we should pursue acquisition of this property through eminent domain. Doing <br />so will address any concerns about favoritism given Mr. Deemer's position on the Planning <br />Commission.
