much of his property is spongy and cannot be mowed, and there is vegetation growth occurring
also. He remarked that he has already sustained property damage which should be remedied and
he feels this development is going to make it worse.

Mr. Jankowski stated that the groundwater has been high. He advised that the topography map
shows much of Mr. Leonard's yard to be at the same delineation of the adjacent wetland
accounting for the sponginess, however, he added that the wetland cannot be drained to make it
lower than the elevation of Mr. Leonard's yard.

Mr. Leonard also commented on the size of the backyards in this subdivision, noting that they may
be able to sell them the first time, but as he is in real estate, he would find it difficult for resale.

Commissioner Deemer noted his concern about the ponding area near Lots 7, 8, 11, and 12.

Mr. Jankowski proceeded to outline the drainage system.

Mr. Leonard inquired whether the area residents are just stuck with the fact that the Ordinary High
Water mark is in error.

Commissioner Deemer stated that unless its proven otherwise, they are stuck with it.

Mr. Leonard reiterated that he didn't feel there had been excess rainfall this last summer and yet the
water level has been high; it simply is not working.

Mr. Sankowski suggested that there might be some sediment in the storm sewer that's affecting it,
so the City will have it cleaned.

Mr. Leonard cautioned proceeding with this plat, stating that an additional 34 more homes to this
area is not going to improve the situation.

Blaine Edmundson, 4937 142nd Lane N.W. - stated that he owned 20 acres on the corner of 153rd
Avenue N.W. and Highway #47, and he expressed concern that the drainage would affect his
property.

ADJOURNMENT

Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to adjourn the
public hearing.

Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue,
Terry, and Thomd. Voting No: None. Absent: Commissioner Holland.

The public hearing adjourned at 8:00 p.m.

Respectfully submitted,

Joa~t~ Kusler
Recording Secretary

Sylvit~ Frolik
Zoning Administrator

Public Hearing/Planning Commission/February 7, 1995
Page 2 of 2
