Absent: Commissioner Holland. <br /> <br />Case #3: Request for Sketch Plan Review of Putter's Field, a Minor <br /> Subdivision; Case of Rich Kerner <br /> <br />This case was reopened upon request by the applicant to address concerns he had regarding the <br />Staff Review letter dated February 1, 1995. <br /> <br />Applicant Rich Kemer inquired about the dedication of the drainage and utility easements. <br /> <br />Zoning Administrator Frolik stated that Mr. Keener should give this information to his surveyor so <br />that the standard drainage and utility easements can be added to the fmal plat. <br /> <br />Mr. Kerner stated that his wetlands have been filled previously, and he inquired as to whether he <br />could remove some of the fill to improve the area. <br /> <br />City Engineer Jankowski advised that he can remove fill and deposit it on high ground or off-site. <br /> <br />Commissioner Deemer also advised that he is allowed to fill up to 400 square feet of wetland. <br /> <br />Chairperson Bawden recessed the meeting at 8:55 p.m. <br /> <br />Chairperson Bawden called the meeting back to order at 9:05 p.m. <br /> <br />Case #5: Request to Renew a Conditional Use Permit for an Asphalt <br /> Production Plant; Case of Commercial Asphalt <br /> <br />Zoning Administrator Frolik stated that Commercial Asphalt has submitted an application for the <br />issuance of a new conditional use permit (CUP) to continue the operation of a hot mix asphalt plant <br />which was first issued by a CUP on July 12, 1988. She reported the applicant has indicated that <br />the operations are intended to be sutus quo as they have been since 1988. <br /> <br />Brent Schlueter, Facilities Planning and Compliance Coordinator for Commercial Asphalt, <br />addressed proposed Findings of Fact #15 and advised that they own the south 30 feet of Lot 2 <br />Block 4 and therefore have fee title access to Basalt Street. He also referenced Term #4 of the <br />proposed CUP, stating that they have been permitted a maximum height of 35 feet for stock piles <br />of material and would like to retain that height limit, not the 32 which is proposed. Mr. Schlueter <br />also noted they would agree to providing a performance bond as outlined in Term #13. <br /> <br />Commissioner Deemer suggested there be a requirement for crushing demolition concrete and <br />asphalt at least once a year, as required of a similar operation in Ramsey, Bury and Carlson. <br /> <br />Commissioner Hendriksen inquired as to the list of properties notified for the public hearing on <br />this matter, and Ms. Frolik distributed the list for the Commission's review. <br /> <br />Chairperson Bawden inquired whether the applicant had a chance to discuss the odor problem with <br />the resident who spoke at the public heating. <br /> <br />Mr. Schleuter replied that he had discussed it with the resident, Mr. Hamilton, and has asked to be <br />contacted immediately when the problem occurs in the future in order to determine what is causing <br />the odor and try to remedy the situation. <br /> <br />Planning Commission/February 7, 1995 <br /> Page 5 of 11 <br /> <br /> <br />
