It also must be made clear <br />that the CUP runs with the land, and therefore, a new owner could come in and take over the same <br />type of operation with different results. She also expressed concern that assaultive behavior might <br />occur in the home because of the wrong mix of kids. She verified the accuracy of Mr. <br />Henderson's statements regarding the range of kids placed in a home. She noted that public safety <br />is a concern mentioned in a CUP and should be addressed. She stated that the legislature is <br />presently flooded with bills concerning the process of placement in these homes, and so this is an <br />unknown variable to consider. She disclosed that the Department of Human Services is also <br />involved in the placement of kids in these homes. She strongly urged the Planning Commission to <br />hold off doing anything other than what is mandated by state statute. <br /> <br />A resident inquired about the CUP process, and Ms. Frolik explained same. <br /> <br />Mr. McLafferty responded to sewage concerns by informing that the Department of Health has <br />been to his home three times, performing tests and measuring the sewage system, and they have <br />determined that it's capacity is sufficient. He also advised that three water tests were performed. <br />He stated that this is a CUP, not a rezoning; he is not asking to be rezone& He explained that he <br />can never have more than eight boys; it's a restriction by the Department of Corrections. He also <br />stressed that he has to follow the rules of the Department of Corrections and the Volunteers of <br />America. <br /> <br />Gail Jaremko, 8443 Mississippi Boulevard N.W., Coon Rapids - reported that Mr. McLafferty <br />requested a variance for sewer from the county. She explained that she lives next door to a group <br />home which is a corporation. No one over 18 lives there, only the children placed there. She <br />announced that this is becoming a franchise industry with a outstanding recidivism rate of 70%. <br /> <br />Mr. McLafferty replied that he only had a 5% rate of recidivism. <br /> <br />Commissioner Hendriksen advised that he is a resident of this area and will abstain from voting. <br />He encouraged the Planning Commission to decide whether they would consider a multi-family <br />home for this area, and on that issue alone should deny this request. <br /> <br />ADJOURNMENT <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Deemer to adjourn the public <br />hearing. <br /> <br />Further Discussion: It was consensus to submit into the record of this public hearing the letter of <br />opposition received from Darryl and Bonita Cadwell, dated April 3, 1995, and the information <br />submitted by Mr. Henderson which includes a Ramsey Police Report of Subject Property and the <br />Department of Corrections Rules Governing Group Foster Homes. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Holland, Deemer, LaDue, <br />Terry, and Thorud. Voting No: None.
