Commissioner Deemer again argued that County Roads gl 16 and #56 and should be taken <br />out. <br /> <br />Mr. Jankowski spoke of a compromise and said he sees this as if the City sees one foot as <br />an adequate setback, if the County decides to have 50 feet, that's all they need. <br /> <br />Commissioner Hendfiksen stated you take property away from me when you add the <br />words "whichever is greater"; you take valuable buildable property away from me. <br /> <br />Commissioner Thomd stated that on County Road gl 16, the policy is 60 feet from the <br />center line of the right-of-way, not center of the road. It does not say "whichever is <br />greater". <br /> <br />Mr. Jankowski stated his desire was to illustrate the difference of what the County is <br />recommending and what the Commission has gone on record as recommending. <br /> <br />Commissioner Deemer stated that if we do not add onto that 60 foot setback, that's fine. <br /> <br />Mr. Jankowski inquired that if the normal setback is 40 feet, would you allow less than <br />that. <br /> <br />Commissioner Deemer replied no. <br /> <br />Mr. Jankowski stated that by taking the position of 83 feet from the center of the fight-of- <br />way, you are saying that. <br /> <br />Commissioner Deemer asked what is the structure set back in the rural or urban area of a <br />house on the comer lot. <br /> <br />Ms. Frolik replied that on a county road, it has to be 50 feet from the right-of-way. If it's <br />the side yard, it would be 10 feet (comer lot - 20 feet). <br /> <br />Commissioner Deemer stated that the County has adopted a policy where you can't access a <br />County Road if the City road is available. We have a policy about no accesses on MSA <br />streets, but the County is so adamant we had to have access on an MSA. <br /> <br />Mr. Jankowski commented that if you have a choice of a busy street and a busier street, <br />you go with the less busy street. <br /> <br />Commissioner Deemer stated he is saying we can have houses closer to County Roads. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to delete #3 <br />in the case information which reads "On County Roads gl 16 and #56 - adopt the County <br />policy of 60 feet from the center line of the fight-of-way plus the City's standard setback <br />and to the 4th sentence - remove the punctuation after center line and add "of the fight-of- <br />way". <br /> <br />Further discussion: Mr. Jankowski stated there is probably a 17 foot difference between <br />the County's policy. If you have a situation of a 66 foot fight-of-way, and then you would <br />have single family homes in the rural district - normally that house would be located 83 feet <br />from the center line but under the County proposal, it would be 100 feet. Commissioner <br />Deemer stated that depends. Commissioner Hendriksen stated that the County did not take <br />120 foot right-of-way when they redid County Road #56.
