Jerry Schmidt, 5831 164th Lane N.W. - stated he was in agreement that the letter stated that the <br />outlot was not buildable, however, it does not refer to this ouflot. With that aside, Mr. Schmidt <br />still felt there was an exchange that took place; they were compensated with three more lots (valued <br />at $50,000-65,000 each) instead of the commercial lot. <br /> <br />Commissioner Deemer indicated that when the driving range was moved, it took three lots away <br />from the commercial area. <br /> <br />Mr. Schmidt explained that because the driving range consumed 3.5 acres of prime commercial <br />property, they requested to go from 20 to 23 lots in order to come up with approximately $180,000 <br />in residential property value to offset the loss of commercial property value. <br /> <br />Commissioner Holland agreed with Mr. Schmidt's interpretation of the letter. <br /> <br />Mr. Schmidt told the Commission that he has been negotiating with Mr. Toilette, and advised that <br />it is his intent to achieve the least amount of impact as far as aesthetics and resale value to his <br />home. He explained that he has developed his home according to recreational property, not <br />commercial property. He reported that he has previously received a letter from the Board of <br />Directors of the golf course with regard to people and balls wandering into neighboring residential <br />yards, and it indicated that "the increased aesthetics and property value that comes from living on a <br />golf course" should offset such a nuisance. He strongly contended that this building was not <br />considered as part of the increased aesthetics provided by living on a golf course. <br /> <br />Commissioner Hendriksen inquired if Mr. Sehmidt felt it would help to rotate the position of the <br />building in order to move it further out of the line of sight. <br /> <br />Mr. Schmidt replied that he has modified the plan so that it would have the least impact on his <br />home, however, the location of the gas line also restricts the placement of the building. It was also <br />his position that screening only helps for four months out of the year. He insisted that no matter <br />where the building is placed at this site, it will have an impact that he cannot live with and he will <br />have to move. Mr. Schmidt also referenced a portion of minutes from the July 26, 1983 City <br />Council meeting wherein Mr. Dom attempted to explain what a PUD is: "Mr. Dom stated that a <br />PUD is a hybrid between zoning and planning; there are a multiple of land uses proposed and then <br />developed by calling out by legal description where those land uses will occur." Mr. Schmidt <br />stated that Outlot G is recreational, and now they are attempting to develop it at commercial <br />standards; this was not the intent this PUD was originally entered into. <br /> <br />Gary Cook, 5830 164th Lane N.W. - stated he opposed putting the building at this site no matter <br />how much it is screened. He stated that the dumping presently occurring in that comer is already <br />disturbing. He stated that this building will not only be commercial, it will look commercial. He <br />stated that when the golf course was built, he made no objections, however he does have <br />objections to this warehouse. <br /> <br />The Planning Commission proceeded to review the Findings of Fact. <br /> <br />It was the consensus of the Planning Commission to accept #1 through #10 as presented. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to amend #11 to read <br />"That Lots 1, 2 and 3, Block 1, Barthel's Rum River Acres are zoned rural residential and are <br />presently used for residential purposes." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Hendriksen, <br />and Holland. Voting No: None.
