Subsequent to that meeting it was determined
that part of the Super Bowl structure encroached on Lot 6 and it would be necessary to replat the
property to eliminate encroachments prior to rezoning Lot 6. Accordingly, the applicants replatted
the 4 lots upon which the Super Bowl structure is located into one commercial lot and two
residential size lots. Thus, the application to rezone the remainder of LOt 6 or the two residential
size lots to R-1 Urban Residential has been reactivated under the new legal description, and forced
a second public hearing held earlier tonight.

The Planning Commission proceeded to review the Findings of Fact..

Motion by Commissioner Deemer and seconded by Commissioner Holland to amend the Findings
of Fact in the aff'mnative and recommend that City Council adopt the amended Findings of Fact
relating to a request from Super Bowl, Inc. and Fitzsimonds Builders to rezone certain property
from B-3 Highway Business to R-1 Urban Residential.

Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland,
Hendriksen, LaDue, and Terry. Voting No: None.
