Absent: Commissioner Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council adopt the amended Findings of Fact relating to Good Value Homes, Inc.'s request for a <br />CUP to grade and export soils. <br /> <br />Motion carried. Absent: Commissioner Thorud. <br /> <br />The Planning Commission proceeded to review the terms of the permit. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to amend #4 to read <br />"The haul route, ingress and egress, shall be as follows: south on Potassium Street N.W., west <br />on 145th Lane N.W., and continuing west on Sunfish Lake Drive to Sunfish Lake Boulevard." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, <br />Holland, LaDue, and Terry. Voting No: None. Absent: Commissioner Thorud. <br /> <br />Ms. Frolik suggested that the Planning Commission review #21 to address their concerns about <br />maintenance of the haul roads. <br /> <br />Commissioner Hendriksen felt that the language was adequate to address his previous concern of <br />maintenance. <br /> <br />Noting the language "the local road authority," Commissioner Deemer inquired if that is the person <br />who owns the road. <br /> <br />Ms. Frolik stated she was unsure whether the City Code defines local road authority, but she <br />suspected Commissioner Deemer's definition is correct. <br /> <br />Mr. Peterson commented that "while Ben Deemer owns the land, we have the right to use it and we <br />are, in effect, the local road authority too." He stated he would prefer the City be the escrow agent <br />for this money, explaining that the goal is to protect streets, public and private streets. <br /> <br />Commissioner Deemer stated he did not have a problem with that. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Holland to recommend that City <br />Council approve Good Value Homes request for a conditional use permit to grade and export soils <br />and adopt the resolution declaring the terms of same, as amended. <br /> <br />Motion carded.
