BOARD BUSINESS/PUBLIC HEARING <br /> <br />Case gl: Request for a Variance to Construct an Accessory Structure <br /> Nearer the Front Property Line than the Principal Structure; <br /> Case of Jeffrey Wise <br /> <br />Chairperson Deemer adjourned the regular portion of the Board of Adjustment meeting at <br />7:02 p.m. in order to conduct the public hearing. <br /> <br />Public Hearing <br /> <br />Chairperson Deemer called the public hearing to order at 7:02 and noted a request from <br />Tom Kucheska, 7881 - 165th Avenue N.W., who requested a survey be done. Mr. <br />Kucheska owns the lot adjacent to Mr. Wise's property. <br /> <br />Presentation <br /> <br />Zoning Administrator Frolik stated that Jeffrey and Teri Wise are requesting a variance to <br />construct an accessory garage nearer the front property line than the principal structure at <br />7901 - 165th Avenue N.W. She informed the Board that the side yards are consumed by <br />the septic system, well, and very mature tree growth. The rear yard consists of wetlands, <br />sharp declines in topography, and substantial tree growth. <br /> <br />Chairperson Deemer stated he visited with a neighbor of the Wise's who has no objection <br />to this request. Also, the applicant is proposing one less stall in the garage to save three <br />trees. <br /> <br />Citizen Input <br /> <br />None <br /> <br />Motion by Boardmember Bawden and seconded by Boardmember Hendriksen to close the <br />public hearing. <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Boardmembers Bawden, Hendriksen, <br />Terry and Thorud. Voting No: None. Absent: Boardmembers Holland and LaDue. <br /> <br />The public hearing adjourned at 7:04 p.m. <br /> <br />Board Business <br /> <br />Chairperson Deemer called the regular portion of the Board of Adjustment meeting back to <br />order at 7:04 p.m. <br /> <br />Zoning Administrator Frolik again noted the submittal from property owner Tom Kucheska <br />requesting that Mr. Wise provide a survey to make sure he is not encroaching on the <br />setbacks or the property lines. <br /> <br />Chairperson Deemer commented that Mr. Wise knows where the front property line is and <br />felt that this should be left to the discretion of the Building Official. He suggested there is <br />no need to have a surveyor sign and notarize the document. <br /> <br />The Board reviewed the findings of fact. <br /> <br /> <br />
