If someone decided to sell 16 acres in order to make some money, he didn't know if <br />the ordinance procedure would stop that, but it would give people an opportunity to discuss <br />it. <br /> <br />Commissioner Goode stated he understood Mr. Schroeder to say at one point that he had <br />figured out a way to get around some of the inconveniences of the procedure. <br /> <br />Mr. Schroeder stated that he did; however, he did not feel comfortable doing it that way. <br />The City was negotiating with a company to locate in town and he was looking at three <br />parcels. Council introduced an ordinance authorizing Staff to enter into negotiations with <br />any of the parcels knowing that by passage time we would know which parcel it would be; <br />this allowed for simultaneous closings. He stated worst case scenario would have been a <br />couple of weeks delay. <br /> <br />Commissioner Goode inquired if everything is left the way it is, what is the worst case <br />scenario time wise. <br /> <br />Mr. Schroeder replied the worst case would be - the deal is struck the day after a Council <br />meeting therefore, it would take about 60 days. <br /> <br />Chairperson Steffen stated he is not comfortable to act on this issue right now. He stated <br />there is a reason the language is there is the first place and he doesn't know exactly what <br />would happen if such language was just taken out as the language may also apply <br />elsewhere. <br /> <br />Mayor Hardin stated that the issue of asking Council to approve three scenarios didn't <br />make Council comfortable either as they would like clarity up front. He suggested rather <br />than eliminating language, language could be added about buying property with the intent <br />of reselling it within 180 days. <br /> <br />Commissioner Goode stated he would feel more comfortable if he understood why there <br />are certain instances where we have to act in 60 days or less on a major sale. <br /> <br />Mr. Schroeder stated that it's been his experience when an industry is making site <br />decisions, they are interested only if property is readily available with a clear title. If we <br />cannot deliver, we lose the business to another city. We are trying to provide good land <br />unencumbered by third party issues. <br /> <br />Commissioner Goode mentioned the "four acres next to a resident" discussion. <br /> <br />Commissioner Swokowski stated that the premise of industrial land has to be included in <br />the section. He felt that more information is needed. <br /> <br />Motion by Commissioner Swokowski and seconded by Commissioner Keifer to table <br />action on this case until the next Charter Commission meeting with instructions to Staff to <br />try to give the Commission some alternatives by adding language to protect residential areas <br />and misuse of the right to buy and sell property. <br /> <br />Motion carried. Voting Yes: Chairperson Steffen, Commissioners Swokowski, Keifer, <br />Goode and Nelson. Voting No: None.
