Mr. A1 Koenig stated that his attorney could not attend tonight's meeting; however, he will <br />be contacting City Attorney Goodrich in the next few days. He reported that his attorney <br />has said that retaining this escrow is illegal because they (Koenig's) do not have a separate <br />agreement with the City of Ramsey to do any remodeling. We have not taken out a <br />building permit or occupancy permit. Mr. Koenig added that Mayor Hardin has a letter <br />from him (Koenig) stating his intentions. He stated he would also like to get a commitment <br />from the City as to when the walkway will be paved in Windemere Woods. <br /> <br />City Administrator Schroeder stated that Council passed a budget for Emerald Pond some <br />time ago for about $93,000. The amount for that budget was due to the revenue received at <br />that time and the $93,000 will have been spent some time this year. We are now slightly <br />above what was budgeted and the Park and Recreation Commission will make a <br />recommendation regarding a budget amendment <br /> <br />Mayor Hardin inquired if the $1,800 in escrow is primarily for driveway. <br /> <br />Mr. Schroeder explained that the development agreement basically says that every lot in the <br />plat has to be in conformance with City Code; this is part of that plat. The promissory note <br />said that the development had to be completely in - in order for payment to be given at all. <br />We did not think that was fair to A1 Koenig; we retained $1,800. Mr. Koenig has <br />suggested that he would be putting in that driveway in short order and remodeling that <br />building. We cannot cause remodeling but we can cause the driveway. At least since <br />1984, interest has not been charged on escrows. We also do not charge any administrative <br />fees. Mr. Schroeder stated he had talked with Mr. Koenig about whether or not a <br />certificate of deposit is acceptable. That would resolve the interest earnings part. <br /> <br />Councilmember Peterson inquired when the driveway will be completed. <br /> <br />Mr. Koenig replied that the driveway will be in this summer. He added that he needs to <br />build a garage lb'st. <br /> <br />Mayor Hardin asked for a time table. <br /> <br />Mr. Koenig stated he would be in to City Hall to apply for a building permit in about a <br />month. <br /> <br />Mr. Schroeder stated if there is no motion, staff will continue with the City's policy as is. <br />We will continue to withhold any interest and we will retain the $1,800. <br /> <br />The Finance Committee expressed agreement with the policy as is. <br /> <br />Case g2: Consider Draft Resident Survey <br /> <br />Beth Malaby, Community Development Intern, stated that a group of Anoka High School <br />students has proposed to create and administer a survey of Ramsey residents, as part of <br />their community service efforts. The concept of the survey is to explore residents' vision <br />for Ramsey in 2010. <br /> <br />One of the students stated that the purpose is to create a better sense of community among <br />the citizens. <br /> <br />Ms. Malaby continued that the students have volunteered to distribute copies of the survey <br />by going door-to-door to Ramsey households. They are requesting funds from the City to <br />pay for return postage for the surveys and also are requesting that the City make copies of <br /> <br />Finance Committee/May 23, 1995 <br /> Page 2 of 6 <br /> <br /> <br />
