Voting No: None. <br /> <br />Case #13: Award of Contract for Improvement Project g95-13 Sewer and <br /> Water Extension for Ramsey Elementary School <br /> <br />City Engineer Jankowski stated that the bids were opened for the Improvement Project <br />g95-13 which involves the extension of sanitary sewer interceptor along Wetland #114P <br />and watermain along County Road #5 to serve the Ramsey Elementary School, its <br />expansion and the former Walter Scroggins property to the north and west of the school <br />which is scheduled for development in 1995 and 1996. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to adopt <br />Resolution #95-06-136 awarding construction contract for Improvement Project g95-13 to <br />Barborossa & Sons in the amount of $729,575.75. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beahen, Zimmerman, Beyer <br />and Peterson. Voting No: None. <br /> <br />Case #14: <br /> <br />Approval of Joint Powers Agreement to the Lower Rum River <br />Watershed Management Organization <br /> <br />City Engineer Jankowski presented Council with a background on watersheds and the <br />watershed management organization. He reminded Council that a draft of an updated joint <br />powers agreement was presented to them in May 1994. One of the most significant <br />changes was the manner in which capital improvement projects are to be implemented and <br />financed. Under the. existing JPA, each member city may decide, at its sole discretion, as <br />to whether they wish to participate in a capital improvement project. The new legislation <br />requires these discretionary options be replaced with mandatory participation if the <br />improvement project is determined to be necessary to implement the goals of the watershed <br />plan. Council had expressed concerns over the fairness of these mandatory requirements in <br />view of the fact that Ramsey contributes 42% of the organization's operating budget. <br />Suggested wording was drafted and discussed with representatives of other member cities, <br />as well as the LRRWMO attorney who drafted the original and proposed updated <br />agreement. Mr. Jankowski believed that, at this point, the draft has been revised to the <br />satisfaction of both the WMO attorney and our own City Attorney. The main point of <br />contention centers around the method which would be used to finance a capital <br />improvement project which may be found to be necessary by the WMO. He summarized <br />the draft presented. The proposed language modification changes the manner in which <br />project costs would be distributed among the project beneficiaries if the members could not <br />agree to the distribution through negotiation. In this event, the parties would agree to <br />submit the matter to arbitration. <br /> <br />City Attorney Goodrich stated he concurs with Mr. Jankowski's statements - it appears to <br />be the best compromise. <br /> <br />Mayor Hardin commented on the amount of review this JPA has had. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Zimmerman to adopt <br />Resolution g95-06-137 approving and amending the Joint Powers Agreement for the City <br />of Ramsey with the Lower Rum River Watershed Management Organization. <br /> <br />Motion carried.
