MEMORANDUM <br /> <br />Date: June 27, 1995 <br /> <br />To: City Council <br /> <br />From: Terry Hendriksen <br /> <br />Subject: Request for Investigation <br /> <br />Attached is a letter from James J. Hanton, Bannigan & Kelly, P.A. At my request Mr. <br />Hanton reviewed Ramsey Council minutes, resolutions and Minnesota statutes. <br /> <br />Mr. Hanton concluded there is reason to believe a violation of MS 471.87 subd.2, has <br />occurred. Mr. Hanton also concluded potential violations of MS 471.88 can not be <br />evaluated without detailed financial information. <br /> <br />Section 2.8 of our City Charter grants the City Council the power to: "make <br />investigations into the affairs of the city and the conduct of any city department, office <br />or agency". This section also grants the power to: "subpoena witnesses, administer <br />oaths, take testimony, and require the production of evidence." <br /> <br />In light of the apparent violation of MS 471.87 subd.2 and the potential Mr. Hardin may <br />have violated MS 471.88. I request the City Council initiate an independent <br />investigation under section 2.8 of the Charter. <br /> <br /> <br />
