year about what the speed was going to be on Sunwood Drive. He mentioned the 30
m.p.h, curves. He stated that the City authorized appraisal of his property but that he is in
limbo. He requested the same consideration that the AEC people have gotten. The Altron
people, with the road as it is now on Sunwood is being moved slightly from their building.
He stated he cannot get them to move it 12 feet. He added that he is not against this
proposal, only that he wants equal treatment.

Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to
approve the preliminary plat for AEC Energy Park contingent upon increasing the easement
between Lots 2 and 3 of Block 3 to 60 feet, with Block 3 receiving access from Sunwood
Drive N.W., and the final plat providing an outlot along the south boundary of the plat for
the possible future extension of 143rd Avenue N.W.

Motion carded. Voting Yes: Mayor Hardin, Councilmembers Beahen, Zimmerman, Beyer
and Peterson. Voting No: None.

Case g'7: Request for a ttome Occupation Permit; Case of Diane
Dempsey

Zoning Administrator Frolik stated that in the spring of 1994, Diane Dempsey applied for a
home occupation permit to conduct doll making classes in her new home at 14794 Krypton
Court N.W. She explained that because Ms. Dempsey was the only home on the block at
that time and her future neighbors would not have had the opportunity for input at the
public hearing, the City Cotmcil granted her an interim use permit for one year. The
consensus was that after a year's time, Ms. Dempsey would have neighbors and it would
be appropriate for her to relocate to a commercial area or reapply for a permanent home
occupation permit. The reapplication would require another public heating and thus give
her new neighbors the opportunity for input. Ms. Frolik reported that no complaints have
been received and that there were no verbal or written comments received at the July 5
public hearing conductexl by the Planning Commission.

Motion by Councilmen~ber Peterson and seconded by Councilmember Beyer to adopt
Resolution #95-07-157 adopting Findings of Fact #0382 relating to a request for a home
occupation permit at 14794 Krypton Court N.W.

Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen
and Zimmerman. Voting No: None.

Motion by Councilmember Beyer and seconded by Councilmember Peterson to adopt
Resolution #95-07-158 approving the issuance of a home occupation permit at 14794
Krypton Court N.W.

Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Peterson, Beahen
and Zimmerman. Voting No: None.

Case #8:

Request for Site Plan Review for an Expansion to Blue Velvet
Car Wash; Case of Blue Velvet, Inc.

Zoning Administrator Frolik explained that Matt Hinrichs and Brian Schmidtbauer of Blue
Velvet, Ine. have acquired the former Tender Touch Car Wash at 14101 St. Francis
Boulevard N.W. and are proposing to expand it into a full service facility. The car wash
will be renamed Blue Velvet. She reported that all setbacks will be met. For an orderly
traffic flow and adequate turning radius into the facility entrance at the east end of the site, it
will be necessary to relocate the existing east curb line 12 feet to the east, right on the
property line. This will necessitate providing for the required landscaped area along all
streets within the Xkimo right-of-way. Staff is also recommending the relocation or
replacement of any existing screening on the east end required to be removed as a result of

City Council/July 25, 1995
