Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution ~95-09-231 receiving bids and awarding contract for Improvement Project g05- <br />16 (Bituminous surfacing of Bison Street between 171st Avenue and 173rd Avenue) to H <br />& M Asphalt in the amount of $32,900. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer, Beahen <br />and Peterson. Voting No: None. <br /> <br />Case #12: Consider Authorization of Improvement Project #95-14 <br /> Sanitary Sewer, Watermain, Storm Sewer and Street <br /> Improvements to Service the Haubrich Addition <br /> <br />City Engineer Jankowski summarized the background of Improvement Project g95-14. On <br />April 25, 1995, a petition was presented to the City Council by two of the five property <br />owners, representing three of the six properties in the Haubrich Addition, for the <br />installation of City sewer and water and subsequent urban standard street restorations. On <br />July 11, 1995, a public hearing was held subsequent to the preparation of a feasibility <br />study outlining the improvements, their costs and financing. The City has waited the <br />required 60 days from the public hearing date. During this time, the City received a <br />petition; signed by owners of 50 percent of the property, in opposition to the proposed <br />project. The City also received another petition signed by owners of 50 percent of the <br />property in favor of the project. Mr. Jankowski explained that should the Council decide to <br />authorize this project, staff is recommending that the project be designed and constructed <br />through a change order to Barborossa, Inc. This contractor has already been retained to <br />place the watermain improvements down 151st Avenue in conjunction with Project g95-13. <br />The unit prices used would be those previously competitively bid on Projects g95-13 and <br />g95-17. This would have the advantage of subjecting the neighborhood to construction <br />activities only once and minimizing the areas of construction disturbance. <br /> <br />Councilmember Zimmerman stated he is against this project. The people in Haubrich do <br />not need sewer and water, they have new septic tanks. They do not need a road either. <br /> <br />Councilmember Beyer expressed opposition to this project also. <br /> <br />Wayne Olson, 5830 - 151st Lane N.W., Ramsey, sated that he is one of the property <br />owners. He stated they have new systems and the return on an investment such as this <br />would be poor. The cost would be in excess of $5,000 a year and that's ridiculous. Based <br />on conversation with City Staff and City Council, City utilities was supposed to be six to <br />eight years down the road - that's palatable - Now is not palatable. Mr. Olson stated he <br />strongly objects to this project and is also speaking on behalf of the Haubrich's and the <br />Croteau's. <br /> <br />Brett Perry, Attorney representing the Olson's, Haubrich's and Croteau's, stated that they <br />have acquired a preliminary analysis of benefits. The report states that no benefit would be <br />conferred to the market value. This would be $10,000 to $37,000 for assessments. That <br />would be trading a private viable system for this and it will not benefit the home as far as <br />market value is concerned. Also, the proposed assessments do not contemplate the <br />thousands of dollars for the SAC and WAC plus all other costs that will be incurred. Mr. <br />Perry stated that Mr. Olson spent more on his septic system than normal at the <br />recommendation of City Staff. Mr. Croteau spent about $10,000 on his system about two <br />years ago. He asked that Council deny this improvement. <br /> <br />City Attorney Goodrich stated that Mr. Perry touched on an order for assessment.
