WHEREAS, Mn/DOT anticipates that the final seoplng document will be published in the latter part of 2003; and WHEREAS, the City Council finds that an interim ordinance to extend the moratorium on the development of certain parcels is necessary to protect the planning process until the final Scoping Document and Scoping Decision related to the Northwest Metro Corridor and River Crossing Study is published. SECTION 3. UNDUE HARDSHIP EXCEPTIONS The City Council may grant an exception to the provisions of this Ordinance when, in its opinion, undue hardship or a practical difficulty may result form strict compliance. In granting an exception, the City Council shall prescribe any conditions that it deems necessary to or desirable for the protection of the public interest. NO exception shall be granted unless the City Council finds: That there are special circumstances or conditions affecting said property such that the strict application of the provisions of this Moratorium Ordinance would deprive the petitioner of the reasonable use of petitioner's land. o That the exception is necessary for the preservation and enjoyment of a substantial property right of the petitioner.
