WHEREAS, Mn/DOT anticipates that the final seoplng document will be published in <br />the latter part of 2003; and <br /> <br /> WHEREAS, the City Council finds that an interim ordinance to extend the moratorium <br />on the development of certain parcels is necessary to protect the planning process until the final <br />Scoping Document and Scoping Decision related to the Northwest Metro Corridor and River <br />Crossing Study is published. <br /> <br />SECTION 3. UNDUE HARDSHIP EXCEPTIONS <br /> <br />The City Council may grant an exception to the provisions of this Ordinance when, in its <br />opinion, undue hardship or a practical difficulty may result form strict compliance. In granting <br />an exception, the City Council shall prescribe any conditions that it deems necessary to or <br />desirable for the protection of the public interest. NO exception shall be granted unless the City <br />Council finds: <br /> <br />That there are special circumstances or conditions affecting said property such that the <br />strict application of the provisions of this Moratorium Ordinance would deprive the <br />petitioner of the reasonable use of petitioner's land. <br /> <br />o <br /> <br />That the exception is necessary for the preservation and enjoyment of a substantial <br />property right of the petitioner. <br /> <br /> <br />
