The puipo, seaf this Section is to prevent.competition with business <br />disti'iC[iand to provide a means through thc cstabl,shment o[speci[ic <br />standards and p'rocedures by which, home occupations can be cbnduc[ed in <br />residemlal neighborhoods without jeopardi~ng the health, safely and general <br />w~l[are of the surrounding I~i~hborho~. In addition, this Section is <br />intended to pro,de a m~chamsm enabling the dktinction between permitted <br />home o~eupatlons and special or customarily "more sensitive" hom~ <br />occupatlon~, so that permitted hum= occupations may be allowed through and <br />ad~nistrative process rather than a'legislative hearing process. <br /> <br />10.2 <br /> <br />ADolical.i.0n. Subject to the non-conformin~ use provision ol5 this Section, <br />all i~ccuRatiom conducted In the home shall'comply with the provisions of <br />this S~ct)on. This Section shall not be construed, however, to apply to .home <br />occupations accessory to farming. <br /> <br />10.3 procedures and?ermits. <br /> <br />1) P6rmilte~-'iome_Occuoation. A_ny permitted home occupation as,de£ined in <br />this Oi'dinance shai-I reituire a "permitted home occupation.permit. Such <br />permits shall be issued subject to the conditions of this. Seenon, other <br /> application Ordinances and State law. This permit may be issued by <br /> the Zoning Administrator or his agent based upon proof of compliance with <br /> the provisions o£ this Section. Application for the "permitted borne <br /> occupation permit" ~hall be accom, panied by a fee as adopted by th~ City <br /> Council. If the AdministratOr clcmes a permitted borne occupation permit <br /> ~o an applicant, the applicant m~y appeal the 0ecision to the Planning <br /> ' Comm),sston. The Planning Commission shall make a recommendation to the <br /> Council, which shall make the final decision. The permit shall remain in <br /> force and effect until such time as there has bean a change in conditions , <br /> or until such time as ~:he arovisiom of this Section have lSeen breached. <br /> At such time a.c the City has reason to believe that either event has ~ <br /> taken place, a public hearing shall be held before the Planning ' , <br /> Commission, The city Council shall make a final decision on whether or <br /> not the permit holder is entitled to the permit. <br /> . <br /> <br />2) Special Home Oecur~stion. Any home occupation which does not meet the, <br /> s~'.cific requirernenis for a permitted home occupation as det'ined in this <br /> Section shall require a "special home occupation permit" which shall be <br /> applied for, reviewed anii disposed of tn a~cordanee with the provisions <br /> of Section 4 o[ this Ordinance (Conditional Use). <br /> <br />3) D~ec}aration o[Conditions. The Planning Commis~lon and City Council may <br /> impose such conditions on the granting of a special home occu. p. adon <br /> permit as may be necessary to carry out the purpose and provmons o£ <br /> this Section, <br /> <br />4) <br /> <br />.~[~_~. A "s~ecial home occupation permit" may be issoed for a <br />period o£ one [1) year alter which the permn may be rmssued [or pc ~ocls <br />o[ up to three (3) years ~ach.
