Case #4: Response from City Attorney on Certain Legal Questions <br /> <br />Referencing item #1 of City Attorney Goodrich's memorandum dated October 27, 1994 (attached <br />to these minutes as Exhibit B), Commissioner Hendriksen stated he was surprised that "any <br />affected person" has the right of appeal. Therefore, the Board of Adjustment is not the final <br />decision-making body, and we need to know how we are protected should somebody decide to <br />exercise that right. <br /> <br />Commissioner Deemer expressed disinterest in changing a policy that seems to be working. <br /> <br />Chairperson Bawden inquired whether the City has had any problems, and Ms. Frolik responded <br />negatively, adding that this was brought up by Mr. Hendriksen because he had a similar situation <br />in another city. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to direct the City <br />Attorney research the possibility of putting a time limit on appeals of variances granted by the City. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, <br />Holland, LaDue, and Thomd. Voting No: None. Absent: Commissioner Ten'y. <br /> <br />Referencing item #2 of City Attorney Goodrich's memorandum dated October 27, 1994, <br />Commissioner Hendriksen inquired what the City's policy was in determining lot size for zoning <br />purposes. <br /> <br />Sylvia Frolik replied that she determines lot size for zoning purposes by the contiguous portion of <br />the parcel on which the home or principal structure is located. <br /> <br />Referencing item #3 of City Attorney Goodrich's memorandum dated October 27, 1994, <br />Chairperson Bawden inquired about current practice for home occupations. <br /> <br />Ms. Frolik stated that we currently call them a conditional use permit for home occupation, but that <br />we could begin naming them home occupation permits. <br /> <br />Commissioner LaDue recommended that the term "use" not be used with "home occupation." <br /> <br />Chairperson .Bawden stated he thinks it's a good idea to have the City Code address home <br />occupations, and Ms. Frolik assured the Commission that it does. <br /> <br />Case #5: Monthly Status Report <br /> <br />This information was noted by the Planning Commission. <br /> <br />Case #6: Zoning Bulletin and Zoning News <br /> <br />This information was noted by the Planning Commission. <br /> <br />COMMISSION INPUT <br /> <br />1) Economic Development Commission's October Meeting <br /> <br />Commissioner Hendriksen stated that he attended the Economic Development Commission (EDC) <br />meeting as a citizen and made no comments until they had reached their decision.
