Mr. Schroeder suggested getting an update on the appraisals. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolutiola S94-02-043 authorizing acquisition of certain permanent street and utility <br />easements by use of MSA §117.011 and §117.042. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Zimmerrnan, Beyer, <br />Hardin and Peterson. Voting No: None. <br /> <br />Case 09: <br /> <br />Consideration of an Ordinance Regulating Adult Use Business <br />Licensing <br /> <br />Police Chief Auspos stated that City Council, at various times from 1990 to the present, <br />has reviewed information on the adoption of an ordinance regulating adult businesses by <br />licensing. !There was an ordinance drafted in September 1990, but it was never introduced. <br />It appeared it was tabled because of ongoing litigation with the adult bookstore. Another <br />ordinanc, was also drafted for introduction in April 1991, but never went beyond being <br />scheduled for consideration for the same reason as the one in 1990. <br /> <br />City Attorney Goodrich stated that the interest in the licensing concept was that it could be <br />used as another tool, along with zoning, to curtail adult use businesses. <br /> <br />City Administrator Schroeder stated that Jim Thompson has cautioned us what to be aware <br />of in licensing. <br /> <br />Attorney Goodrich stated that the City's zoning ordinance is constitutional and the City is <br />within its rights to enforce it. <br /> <br />Councilmcmber Zimmerman commented that the City regulates plumbers and contractors, <br />so why not other types of businesses. <br /> <br />Attorney Goodrich recommended bringing a valid ordinance for Council to review. <br /> <br />Councilmember Zimmerman added that it would show the public that Council is concerned <br />about adult use businesses. <br /> <br />Consensus of the Council was that Staff should bring a valid ordinance for Council to <br />review. <br /> <br />Case #10: 1994 LELS Contract <br /> <br />City Administrator Schroeder stated that the Negotiating Committee has been meeting with <br />Law Enforcement Labor Services (LELS). He stated he was fairly comfortable that LELS <br />would ratify the City's offer; however, that is not what happened. He stated Staffs <br />recommendation was that arbitration should be pursued and that his position still is that <br />Council should not waiver. He suggested that the patrol unit is compensated fairly. <br /> <br />Councilmcmber Beyer felt that the Negotiating Committee should meet with LELS again <br />before telling them to go to arbitration. <br /> <br />Mr. Schroeder clarified that "we are not asking them to file for arbitration". <br /> <br />Mayor Gilbertson felt that LELS had been offered a fair contract. <br /> <br />City Council/February 22, 1994 <br /> Page 10 of 13 <br /> <br /> <br />
