Councilmember Peterson inquired if a CUP could be granted to the person as opposed to <br />be granted on the property. <br /> <br />Councilmember Zimmerman was reluctant because a neighbor was opposed to it. <br /> <br />Ms. Jackson stated her neighbor was concerned about people moving in and out a lot. She <br />stated she would be charging a damage deposit and asking for a one-year lease and added <br />that she is looking for stable tenants. <br /> <br />Councilmember Zimrnerman stated he would be more in favor of it if it were offered to be <br />rented to only one person. He suggested that this case be tabled until there is an accessory <br />apartment ordinance. <br /> <br />Councilrnember Hardin stated he has concerns about this entire issue. <br /> <br />Councilmember Petcrson stated he would vote no on this or vote to table this case until <br />there is an ordinance dealing with this issue. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to table this <br />case until the Planning Commission has a chance to research this and an ordinance <br />pertaining to accessory apartments has been presented. <br /> <br />Further discussion: Councilmember Hardin inquired if the Building Official has reviewed <br />this property to which Ms. Frolik replied he had reviewed the site plan and that he will be <br />visiting the property also. Cotmcilmember Hardin suggested the Fire Department visit the <br />property also. Ms. Frolik stated that when the Building Official does his inspections, he <br />makes sure there are fire alarms, egress windows, etc. Ms. Jackson inquired <br />approximately how long this would take. Ms. Frolik replied that it could take up to five or <br />s~x months. Ms. Jackson expressed the wish that Council would approve it now as it's <br />already been a long process getting to this point. She stated she really wanted to get a <br />renter in her home. She added that there was a family of five living in the home before her. <br />Ms. Jackson stated that it would really help her out even if Council just approved the <br />interim use permit. Mayor Gilbertson reminded Ms. Jackson that she bought residential <br />property. Ms. Jackson acknowledged that she had bought residential property and that she <br />realized it was not "a given" that she could use the lower level for rental property. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer, Hardin <br />and Zimmem~an. Voting No: None. <br /> <br />Case /t8: <br /> <br />Introduce Ordinance to Rezone Property from Industrial to R-1 <br />Urban Residential, Multiple Residential (MR) and B-2 <br />Business; Case of North Suburban Development Company, <br />In c. <br /> <br />Zoning Administrator Frolik stated that Jack Menkveld of North Suburban Development <br />was granted final plat approval of Sunfish Square. The plat consists of 69 single family <br />residential lots, 8.7 acres of multiple residential units, and one acre of commercial. Ms. <br />Frolik stated that the property is cnrrently zoned Industrial and the rezoning to single <br />family, multiple residential, and commercial is necessary to facilitate the approved plat. <br />The Planning Commission conducted a public hearing regarding the rezoning request and <br />there were no verbal or written comments submitted. <br /> <br />City Council/July 26, 1994 <br /> Page 16 of 27 <br /> <br /> <br />
