Councilmember Zimmerman questioned how the agreement can state that the MPCA will <br />not approve the ski hill project if the MPCA has not responded to that in written fashion. <br />He suggested that Council could not agree to that pan of the agreement. <br /> <br />Mr. Goodrich stated that the original ski hill agreement stated 50 acres would be restricted <br />to parkland, etc. We have asked that restrictions be removed and he thought they would <br />be. <br /> <br />Mayor Gilbertson felt this is the same as cash. <br /> <br />Councilmember Peterson inquired about the test wells - the liability and access, etc. <br /> <br />Mr. Goodrich stated that Waste Management wanted to have easements for the test wells. <br />He stated he left that out because Mr. Schroeder had indicated that this could be negotiated. <br /> <br />A question arose about the approximate 4-acre triangle parcel previously discussed. Mr. <br />Goodrich stated he would review to see if this agreement addresses this parcel. <br /> <br />Councilmember Peterson inquired if Mr. Otter appeared "comfortable" with this proposed <br />agreement. <br /> <br />Councilmember Zimmerman inquired, getting back to the first WHEREAS on page 2 that <br />was previously discussed, if the rest of Council agreed that it should be left worded as ".. <br />. the Minnesota Pollution Control Agency has informally stated that it may_ not approve". <br />He questioned if the City could request MPCA respond to this in writing. He felt this <br />would clear things up to the general public. <br /> <br />Mr. Goodrich stated he is concerned about how much documentation should be on record. <br /> <br />Mr. Schroeder suggested that the agreement could state this is contingent upon the ski hill <br />response from the MPCA, and language relating to the test wells and the 4-acre remnant of <br />property. With these changes, we could get a copy sent off to Waste Management with a <br />proposal that they approve and send it back to City Council for final approval. <br /> <br />Motion by Mayor Gilbertson and seconded by Councilmember Peterson to approve of this <br />agreement contingent upon response from the MPCA, the addition of test well language, <br />and addressing the 4-acre parcel remnant north of 153rd. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Hardin and <br />Zimmerman. Voting No: None. Absent: CouncilmemberBeyer. <br /> <br />Case #'/: Report From Finance Committee <br /> <br />Finance Officer Hart stated that the Finance Committee is recommending an 8 percent levy <br />which equals a 6.72 percent dollar increase. This amounts to an additional $86,465 for the <br />City of Ramsey. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to adopt <br />Resolution #94-09-173 approving the proposed maximum 1994, payable 1995, tax levy <br />and scheduling the budget public hearing date for Wednesday, November 30, 1994, with a <br />reconvene date, if necessary, of Wednesday, December 7, 1994. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson and <br />Zimmerman. Voting No: CouncilmemberHardin.
