DISCUSSION REGARDING PROPOSED ORDINANCE TO MOVE STRUCTURES INTO AND WITHIN THE CITY OF By: Zoning Administrator Sylvia Frolik Background: It was brought to the attention of the Planning Commission and City Council that there eun'enfly is no established policy or code requirements for obtaining approval to move structures into and within the City of Ramsey. Historically, the unwritten policy has been to charge the applicant $100.00 to ¢ovg the cost of the Building Official's inspection of the structures to be moved into Ramsey. FOllowing that, the requests have either been brought directly to Council for approval; or sometimes they are reviewed by both the Planning and Zoning Commission and the City Council; sometimes there was a public hearing; sometimes findings of fact are adopted; and generally them was some sort of agreement entered into by the applicant and the City. Upon approval of the structures tO be moved in, the applicant must then obtain a building permit just as if the project were new construction. Based on the practice in some of the surrounding communities, Staff and the Planning Commissiofl drafted an ordinance whereby requests to move in structures would be approved at a Staff level and in the case of homes, a $3,000.00 financial guarantee would be required to ensure proper compleuon of the project. Observations: This proposed ordinance failed to achieve Council introduction. City Council is concerned that there are no provisions in the ordinance for an architectural review that would ensure that the structure to be moved in is compatible with existing structures in the neighborhood, and that possibly th6 mOving of structures into the City's urban district should be prohibited altogether. The issue wlts sent back to the Planning Commission for farther review and consideration. The Planning Commission directed City Staff to draft an ordinance amendment for Council consideration that would absolutely prohibit the moving of structures into and within the entire City of Ramsey. For your review and discussion purposes, the most recent version of the draft ordinance is enclosed. Recommendation: City Staff rettuests that there be some one-on-one discussion of this issue to be sure that absolute prohibition is what Council is looking for when they returned the matter to the Commission for further review.
