Commissioner Anderson stated that it can happen in the reverse also - maybe your septic <br />system fails and you do not have any utilities available to you - then you are in trouble. <br />She felt that the authority should remain with the City Council but she suggested they be <br />careful in what they use as a test case. <br /> <br />Mr. Norman pointed out that there is a moratorium in place until the comprehensive <br />planning is complete, but chances are there will be some requests for major expansions. <br /> <br />Commissioner Anderson inquired if Council feels obligated to passing a comprehensive <br />plan that's not in compliance with the Charter - or are they forbidden to do a comp plan <br />that's not in compliance with the Charter. <br /> <br />Mr. Goodrich stated that some people are saying that the Council is violating the Charter <br />because they have taken a vote (four-fifths) to do anything yet. <br /> <br />Mr. Norman reminded the Charter Commission that if this section of the Charter is <br />determined invalid, the comp plan will not.be in conflict with the Charter. <br /> <br />Mr. Goodrich cautioned that there is no course of action that is risk-free. <br /> <br />Motion by Commissioner Kiefer and seconded by Chairperson Peterson to send the <br />following language back to Council: We (the Charter Commission) have received the <br />legal opinion on Section 14.1 as provided by the law offices of Kennedy and Graven and <br />have reviewed its contents and conclusions. The Ramsey City Charter Commission finds <br />that the legal opinion offered by Charles L. LeFevere of Kennedy and Graven is a logical <br />and reasonable opinion. The Commission agrees that Section 14.1.3 is likely not lawful <br />and is inconsistent with the Municipal Land Planning Act and with the legislative grant of <br />power to adopt Charter provisions found in Minnesota Statutes, Chapter 410. <br /> <br />Further discussion: Commissioner Anderson stated that the question she raised is about <br />the person who does need the sewer and water. How are we fair to everyone? We have <br />to consider both sides as it appears that both sides need protection. <br /> <br />Motion carried. Voting Yes: Chairperson Peterson, Commissioner Kiefer, Anderson and <br />Spain Brist. Voting No: Commissioner Vogt.
