PUBLIC HEARING
BOARD OF ADJUSTMENT
CITY OF RAMSEY
ANOKA COUNTY
STATE OF MINNESOTA

The Ramsey Board of Adjustment conducted a public hearing on Thursday, May 27, 1993 at the
Ramsey Municipal Center, 15153 Nowthen Boulevard N.W., Ramsey, Minnesota to hear input
regarding a request for a variance to construct an accessory structure nearer the front property line
than the principal structure; ease of Charles and Jan Hart.

Members Present:

Chairperson Terry Hendriksen
Board Member Benjamin Deemer (arrived at 7:32 p.m.)
Board Member Charles LaDue
Board Member Michael Terry
Board Member Bradley Thomd

Members Absent:

Board Member David Bawden
Board Member Paul Holland

Also Present:

Zoning Administrator Sylvia Frolik

CALL TO ORDER

Chairperson Hendriksen called the public hearing to order at 7:31 p.m.

PRESENTATION

Zoning Administrator Fmlik stated that Charles and Jan Hart are requesting a variance to construct
a 32'x32' accessory garage nearer the front property line than the principal structure at 7230 153rd
Lane N.W. Ms. Frolik explained that the developers of the lot located the house 84 feet from the
front property line, creating an 84 foot front yard setback. The Harts are proposing to construct an
accessory garage approximately 60 feet from the front property line. The Harts are restricted from
building their accessory structure in the rear yard because of sharp inclines in topography and
dense, mature tree growth.

CITIZEN INPUT

Will Berry, 7220 153rd Lane N.W. - stated he was all in favor of the variance for the garage.

Tom Williams, 5180 157th Lane N.W. - stated he was tired of the City changing its roles, and that
he felt the City should either uphold the ordinance or take it off the books. He said his objection
had nothing .to do with anyone's particular property, but that it has to do with the roles of the City.
He stated the variance would affect many people because it sets a precedent, and that you can't stop
it once you deviate from the plan. He added that the applicants understood the setback when they
bought the property.

Ms. Frolik explained that state statute allows for variances when some physical feature unique to
the property creates a hardship; the hardship cannot be created by the property owner.

Board Member LaDue also explained the variance procedure.

Chairperson Hendriksen stated the Board will consider what they have done in the past so that they
are consistent.

Public Hearing/Board of Adjustment/May 27, 1993
Page 1 of 2
