Tony Emmerich, representing Gor-em, LLC, commented that the Rivers Bend subdivision had a 5 <br />foot setback. <br /> <br />The Board of Adjustment reviewed the findings of fact. <br /> <br />Motion by Board Member Bawden and seconded by Board Member LaDue to adopt Resolution <br />g93-06-100 adopting Findings of Fact #0335 relating to a request for a variance to side yard <br />setback requirements on parcels in the plat of Amber Ridge. <br /> <br />Motion carried. Voting Yes: Chairperson Hendriksen, Board Members Bawden, LaDue, Deemer, <br />Holland and Terry. Voting No: None. Absent: Board Member Thom& <br /> <br />The Board proceeded to review the terms of the variance. <br /> <br />Board Member Deemer stated that the hardship was that a 3-car garage would not fit with the <br />current setback and suggested making a 3-car garage one of the conditions so as not to allow a 2- <br />car garage built at the 6-foot setback. <br /> <br />Mr. Emmefich stated that there would be some 2-car garages but that 90% of the homes they build <br />are built so that the owner can add the third garage when they can afford it. <br /> <br />City Admirdstxator Schroeder explained that the rationale mentioned was 3-car garages but that the <br />issue is that the structure is allowed to be wider; in other words, does the City want to allow 64- <br />foot structures or limit to a 57-foot building pad. <br /> <br />Mr. Emmefich confirmed that they are trying to build larger homes. <br /> <br />The Board was polled on whether to stipulate a 3-car garage as the hardship for the variance. <br />Board Members Deemer and Terry were for the stipulation; Chairperson Hendriksen and Board <br />Members Bawden, Holland and LaDue were against, stating that it was unnecessarily burdensome <br />for Staff andthat this was just a matter of expediency since City Council will be changing the <br />ordinance beeanse they recognize the hardship. <br /> <br />Board Member Deemer cautioned that the minimums become the maximums. <br /> <br />Mr. Emmerich stated that it depended on what was being limited. He explained that they are <br />marketing to mid-size and up with an average home of 1100 square feet. <br /> <br />Motion by Board Member Bawden and seconded by Board Member Holland to adopt Resolution <br />g93-06-101 approving the issuance of a variance to side yard setbacks in the plat of Amber Ridge <br />and declaring terms of same. <br /> <br />Motion carried. Voting Yes: Chairperson Hendriksen, Board Members Bawden, Holland, and <br />LaDue. Voting No: Board Members Deemer and Terry. Absent: Board Member Thom& <br /> <br />ADJOURNMENT <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Holland to adjourn the meeting. <br /> <br />Motion carried. Voting Yes: Chairperson Hendriksen, Board Members LaDue, Holland, <br />Bawden, Deemer, and Terry. Voting No: None.
