PUBLIC H/EARINGS <br /> <br />Chairperson Hendriksen adjourned the regular Board of Adjustment meeting at 7:37 p.m. in order <br />to conduct tha following public hearing: <br /> <br />1) <br /> <br />Request for a variance to construct an accessory structure nearer the front property line than <br />the principal structure; case of Gary Miller. <br /> <br />ChairpersonHendriksen called the regular Board of Adjustment meeting back to order at 7:39 p.m. <br /> <br />BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Variance to Construct an Accessory Structure Nearer <br />the Front Property Line than the Principal Structure; Case of Gary <br />Miller <br /> <br />Zoning Administrator Frolik stated that Gary Miller's property is situated on the Mississippi River, <br />and his home is located approximately 248 feet from the front property line and 135 feet from the <br />river. Mr. Miller is proposing to construct an accessory structure approximately 152 feet from the <br />front propert3r line. Ms. Frolik explained there is not a sufficient amount of width to the property <br />to construct the garage in the side yards, and it is not possible to site the accessory structure in the <br />rear yard bee. ause it would then encroach on the Mississippi River setback requirement (which was <br />adopted 8 years after the home was built). Ms. Frolik also noted that the location of the on-site <br />septic system in the side yard also hinders construction in accordance with City Code. <br /> <br />Board Member Terry questioned whether the location of the existing garage required a variance, <br />and Ms. Frolik stated there were no other variances in the property file. <br /> <br />Gary Miller stated that the existing garage was built in 1967, at which time he was not the owner. <br /> <br />It was the consensus of the Board to make the variance inclusive of the existing garage also. <br /> <br />Chairperson Hendriksen inquired whether the neighboring properties' structures were closer to the <br />front property 'line, and Mr. Miller advised they were not. <br /> <br />Discussion ensued around the aerial map of the location. <br /> <br />Chairperson Hendriksen inquired about the acreage of the parcel, and Mr. Miller stated it was <br />approximately one acre. Chairperson Hendriksen advised Staff to reflect the acreage in the <br />variance. <br /> <br />The Board of Adjustment proceeded to review the Findings of Fact <br /> <br />It was the consensus of the Board that #1 through #12 would remain as presented. <br /> <br />Motion by Board Member Deemer and seconded by Board Member Bawden to delete #13. <br /> <br />Motion carried. Voting Yes: Chairperson Hendriksen, Board Members Deemer, Bawden, LaDue, <br />Terry, and Thorud. Voting No: None. Absent: Board MemberHolland. <br /> <br />Motion by Board Member Bawden and seconded by Board Member Terry to amend #14 through <br />#20 in the affirmative. <br /> <br />Board of Adjustment/October 21, 1993 <br /> Page 2 of 4 <br /> <br /> <br />
