CASE # ADOPT ORDINANCE TO VACATE DRAINAGE AND UTILITY EASEMENT ON LOT 1, BLOCK 1, RIVEI~yIEW BOWL; CASE OF TIM HOLM By: 'Community Development Director Sylvia Frolik Background: On July 8, 2003, the City Council introduced an ordinance to vacate a 5 foot drainage and utility easement on the southwest property line of Lot 1, Block 1, Riverview Bowl. That property line was the subject of an administrative subdivision with Lot 3, Block 4, Riverside West, The result of the administrative subdivision was that the southwest property line of the Superbowl site was realigned 24 feet to the north. In conjunction with 'Administrative Subdivisions, a routine procedure is to vacate any drainage and utility easements on existing common property lines and dedicate replacement drainage and utility easements on what will be the new common property line. The following items are enclosed: a) b) c) Site location map Exhibit prepared by Hakanson Anderson Associates identifying easement to be vacated and replacement easement to be dedicated Proposed ordinance to vacate drainage .and utility easement Notification: In accordance with State Statue, property owners within 350 feet of the subject property were notified of the public hearing to consider vacating the existing drainage and utility easement on current common property line. Observations: In accordance with the City Charter, the ordinance to vacate the existing drainage and utility easement is now eligible for adoption: Recommendation: City Staff recommends that Council adopt the ordinance to vacate the drainage and utility easement. Council Action: Motion to adopt Ordinance #03- to vacate the 5 foot drainage and utility easement on the westerly 200 feet of Lot 1, Block 1, Riverview Bowl.
