16. <br /> <br />being notified by an outside agency~that the appropriate permit(s) was not obtained from the <br />applicable agency. Approval of the building foundation requires a certificate of elevation <br />signed by a-licensed (State of Minnesota), professional land surveyor, ..verifying that the <br />elevation complies with the approved grading plan for the Plat. <br /> <br />No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the <br />lot is provided including the installation of at least one layer of bituminous surfacing; (b) <br />boulevard sod and landscape trees, or escrow for same, have been provided; (c) for lots that <br />have a slope of less than 2%, a certificate of grading, prepared by a licensed (State of <br />Minnesota), professional land surveyor, must be provided to the City documenting that the <br />flattest grade on the lot is i % or greater. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />Cash, Land, and Park Improvements. The Plat is located in the Autumn Heights <br />Recreation District. The CITY has enacted park dedication fees in the amount of $1,800 per <br />new lot created. The Plat is creating 11 new lots and therefore the DEVELOPER is subject <br />to park dedication in the amount of Nineteen Thousand Eight Hundred Dollars and no cents <br />($19,800.00) (11 x $1,800.00). The one (1) existing homestead is exempt from this fee. In <br />order to provide for a neighbor connection from the Plat to Autumn Heights residential <br />subdivision, the DEVELOPER herein agrees to construct an access connection and parking <br />lot improvements within Autumn Heights Park in accordance with final construction plans <br />dated July 3, 2003, revised ., prepared by Bogart Pederson and Associates. The <br />CITY estimates that said improvements will exceed park dedication fees collected from this <br />Plat and therefore the City Mil issue a payment for an agreed upon amount after the CITY <br />accepts the improvements and receives a copy of an invoice detailing Construction costs. In <br />the event construction costs of said improvements do not exceed park dedication fees <br />($I9,800) required from this Plat, the DEVELOPER will pay the difference between park <br />dedication requirements and actual construction costs of said improvements. <br /> <br />17. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />Trail Development and Fees. The City Council has established a trail development fee in <br />the amount of Four Hundred Seventy Five Dollars and no cents ($475.00) per lot. The <br />existing homestead is exempt from this fee.' The Plat is subject to trail development fees in <br />the amount of Five Thousand Two Hundred Twenty Five Dollars and no cents ($5,225.00) <br />(I1 tots x $475.00 per lot). The DEVELOPER agrees to construct an 8-foot wide <br />bituminous trail along the Arrnstrong 'Blvd. to 167~h Avenue. The CITY herein agrees to. <br />credit the trail development fees due on the Plat in an amount equal to the surface costs <br />associated with the trail segment located outside the boundaries of the Plat.
