Restored areas shall be surfaced with a soil of a quality at least equal to the topsoil of land area, s immediately surrounding the work site, and to a depth of at least six inches. The topsoil shall be seeded, sodded, or planted with grasses. Trees and. shrubs may also be planted but not as a substitute for grasses. Such planting shall adequately retard soil erosion. do The finished grade shall be such that it will not adversely affect the surrounding land or future development of the work site and shall be consistent with the end use plan. Within thirty (30) days after the deposit of approved fill materials, the filled area shall be covered with a minimum of six (6) inches clean fill, and the depth of the fill shall be controlled 'to blend with the surrounding ground conditions. Subd. 12. Existing Operations. Existing grading, mining and filling operations Shall comply with these provisions within 180 days following the effective date of this City Code. ' ' 9.11.13 Adult Uses Subd. 1. Purpose. The nature of adult uses is such that they are recognized as having adverse secondary characteristics, particularly when they are accessible to minors and located near residential property or related residential uses such as schools, day care centers, libraries or parks. Furthermore, the concentration of adult uses has an adverse effect upon the use and enjoyment 0f adjacent areas. The nature of adult uses requires that they not be allowed within certain zoning districts, or within minimum distances from each other or residential uses. Special regulation of adult uses is- necessary to ensure that the adverse secondary effects would not contribute or enhance criminal activity in the area of such uses nor will it contribute to the blighting or downgrading of the surrounding property and lessening of its value. Subd. 2. General. Adult uses as defined in this Chapter shall be subject to the following general provisions: a. Activities classified as obscene are not permitted and are prohibited. Adult uses, either principal or accessory, shall be prohibited from locating in any building which is also utilized for residential purposes. Adult uses, either principal or accessory, shall be prohibited from locating in any place which is also used to dispense or consume alcoholic beverages. An adult'use which does not qualify, as an accessory use .pursuant to Subdivision 4.a. of this sub-section, shall be classified as an adult use - principal. Subd. 3. Adult Uses - Principal Adult use-principal shall be located at least 1,000 radial feet, as measured in a straight line from the closest point of the property, line of the building upon which the adult use-principal is located to the property line of: 24
