ORDINANCE #03- <br /> <br /> CITY OF RAMSEY <br />ANOKA COUN'I~Y STATE OF MINNESOTA <br /> <br />AN AMENDMENT TO cHApTER 9 WHICH IS KNOWN AS THE ZONING AND <br />SUBDIVISION OF LAND CHAPTER OF THE CITY CODE .OF RAMSEY, <br />MINNESOTA. <br /> <br />AN ORDINANCE AMENDING SECTION 9.14 "SOLID WASTE" OF CHAPTER 9 OF <br />THE CITY CODE OF RAMSEY, MINNESOTA. <br /> <br />The City of Ramsey ordains: <br /> <br />SECTION 1. AMENDMENT <br />The following sub-section of 9.14 is hereby amended to read as follows: <br /> <br />9.14.04 Term of Permits. The permit shall be subject to annual review for conformance <br />with this City Code and performance of the permit holder. The Council may also require a <br />performance bond, cash escrow, letter of credit or other financial assurance from the landowner <br />or operator to guarantee conformance with these regulations. Ali property owners and residents <br />within 1,000 feet of the site shall be notified of the annual conditional use permit review. <br /> <br />The following sub-section is hereby added to Section 9.14 to read as follows: <br /> <br />9.14.13 Mixed Solid Waste and Recycling Transfer Facilities. <br /> <br />aJ <br /> <br />Use Restriction. The following regulations shall be observed by any person <br />applying for a q'onditional use permit or to whom a permit is issued by the <br />City for the construction and operation of a mixed solid waste and recycling <br />transfer facility. These regulations shall govern the construction and <br />operation of all waste disposal facilities and any failure to observe these <br />regulation shall be sufficient grounds for the denial or revocation of the <br />conditional use permit by the Council. <br /> <br />1. The rUles established by the Minnesota Pollution Control Agency relating <br /> to Solid Waste (SR 7035) must be strictly adhered. <br />2. All transfer activities shall occur in an enclosed building. <br />3. Enclosed buildings shall be at least 350 feet from property zoned or used <br /> for residential or park purposes. <br /> <br />SECTION 3. SUMMARY <br /> <br />The following official summary of Ordinance #03-__ has been approved by the City Council of <br />the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. <br /> <br />It is the intent and effect of Ordinance #03-A to amend Rarnsey City Code Chapter 9 (Zoning <br />and Subdivision of Land), Subsection 9.14 (Solid Waste) to elirninate the 5 year term limit on <br />conditional use permits and to also require conditional use permits for mixed solid waste and <br />recycling transfer stations. <br /> <br />-427- <br /> <br /> <br />
